Synopsis: Teacher certification fees and incentives. Provides that the department of education shall each year pay the certification fees for up to 2,000 teachers who participate in the certification process offered by the National Board for Professional Teaching Standards. Annually appropriates from the state general fund the amounts necessary to pay the certification fees. Provides a national board certification incentive grant of $5,000 to school corporations for each teacher employed by a school corporation who holds a valid certification from the National Board for Professional Teaching Standards and who is a classroom teacher.

HOUSE BILL No. 1422



    A BILL FOR AN ACT to amend the Indiana Code concerning education and to make an appropriation.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 20-28-13; (13)IN1422.1.1. -->     SECTION 1. IC 20-28-13 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]:
     Chapter 13. Payment of National Board Certification Fees
    Sec. 1. As used in this chapter, "national board" refers to the National Board for Professional Teaching Standards, a nonpartisan, independent, and nonprofit board composed of teachers and others that:
        (1) has developed a set of standards for teachers; and
        (2) operates a national voluntary system to assess and certify teachers who meet the board's standards.
    Sec. 2. Except as otherwise provided in this chapter, if a teacher employed by a school corporation:
        (1) applies to participate in the certification program offered by the national board; and
        (2) applies to the department of education for payment of certification fees charged to the teacher by the national

board;
the department shall pay on behalf of the teacher the certification fees charged to the teacher by the national board.
    Sec. 3. (a) The department may not pay certification fees under this section for more than two thousand (2,000) teachers in a calendar year.

    (b) The department shall record the time of filing of each application for payment of certification fees under this section and shall pay the certification fees in the chronological order in which the applications are filed in the calendar year. If the department has paid certification fees for two thousand (2,000) teachers for a year, the department may not pay any additional certification fees for the year, but may, if an applicant requests, approve the payment of certification fees with respect to the next calendar year.
    Sec. 4. The amounts necessary to pay certification fees under this section are annually appropriated to the department from the state general fund.

        (1) as basic tuition support;
        (2) for honors diploma awards;
        (3) for primetime distributions;
        (4) for special education grants; and
        (5) for career and technical education grants; and
         (6) for national board certification incentive grants;
for a particular year exceeds the maximum state distribution for a calendar year, the amount to be distributed for state tuition support under this article to each school corporation during each of the last six (6) months of the year shall be proportionately reduced so that the total reductions equal the amount of the excess.

(a) As used in this section, "national board" refers to the National Board for Professional Teaching Standards, a nonpartisan, independent, and nonprofit board composed of teachers and others that:
        (1) has developed a set of standards for teachers; and
        (2) operates a national voluntary system to assess and certify teachers who meet the board's standards.
    (b) A school corporation is eligible for a national board

certification incentive grant in the amount determined under STEP TWO of the following formula:
        STEP ONE: Determine the number of teachers employed by the school corporation in the school year ending in the current calendar year who:
            (A) hold valid certifications from the national board; and
            (B) are classroom teachers.
        STEP TWO: Multiply the STEP ONE amount by five thousand dollars ($5,000).
    (c) Money that a school corporation receives for a national board certification incentive grant under this section shall be deposited in the school corporation's general fund and may be used for any general fund purpose.
