Synopsis: Maintenance of Little Calumet River levees. Provides that
the department of natural resources has the sole responsibility and
authority to maintain and repair the levees along the west arm of the
Little Calumet River and Burns Waterway in Lake County and Porter
County.

A BILL FOR AN ACT to amend the Indiana Code concerning
natural and cultural resources.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 14-13-2-32 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2011]: Sec. 32. (a) Notwithstanding section 4(2) of this chapter,
the department has the sole responsibility and authority to
maintain and repair the levees along the west arm of the Little
Calumet River and Burns Waterway in Lake County and Porter
County.
(b) The department may consult with the commission concerning the planning and the priorities for the maintenance and repair of levees under subsection (a).
