    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 9-29-17; (11)IN1243.1.1. -->     SECTION 1. IC 9-29-17 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JANUARY 1, 2012]:
     Chapter 17. Electric Motor Vehicle Highway Maintenance Fee
    Sec. 1. This chapter applies to registration years beginning after December 31, 2011.
    Sec. 2. As used in this chapter, "electric motor vehicle" means a motor vehicle subject to registration under IC 9-18 that is primarily powered by an electric motor that draws current from rechargeable storage batteries, fuel cells, photovoltaic arrays, or other sources of electric current. The term includes a motor vehicle equipped with a gasoline powered motor that:
        (1) is used to generate electric current to supplement the electric current from a rechargeable storage battery, fuel cell, photovoltaic array, or other source; but
        (2) is not capable of applying power to the motor vehicle's drive wheels.
    Sec. 3. There is imposed an annual electric motor vehicle highway maintenance fee of one hundred dollars ($100) upon each electric motor vehicle registered in Indiana.
    Sec. 4. The bureau shall collect the fee imposed by section 3 of this chapter at the time that the bureau collects the regular registration fee imposed on the electric motor vehicle under IC 9-18.

     Sec. 5. Fees collected under this chapter must be deposited in the motor vehicle highway account under IC 8-14-1.
