Bill Title: Regulation of confined feeding operations. Amends the law on confined feeding operations (CFOs), which include any confined feeding of at least 300 cattle, 600 swine or sheep, 30,000 fowl, or 500 horses. Prohibits the department of environmental management (department) from granting approval for the construction or expansion of a CFO: (1) if a manure unit located at the CFO would be located less than 500 feet from a residence on the site of the CFO, less than 1,000 feet from a residence outside the CFO, or less than 1,000 feet from a public or private water supply well, a public or private water supply surface intake structure, or a publicly or privately owned reservoir or lake; or (2) if an exhaust system used to remove air from an enclosed animal containment unit at the CFO expels the air in the direction of a residential area that is located less than 1,000 feet from the enclosed animal containment unit and that was in existence as a residential area before the exhaust system began to be used. Prohibits an alteration of a CFO that was in operation before July 1, 2019, if the CFO, as altered, would violate the manure unit restriction or the exhaust system restriction. Requires the environmental rules board to adopt rules establishing restrictions on air pollution from CFOs. Provides that the rules must restrict hydrogen sulfide, methane, ammonia, and particulate matter from a CFO in the ambient air measured: (1) at the location of the CFO; and (2) in areas that are outside the CFO but near enough to the CFO to be affected by air pollutants from the CFO. Requires the department to enforce these rules.
