Bill Title: Amends the Illinois Vehicle Code and the Illinois Marriage and Dissolution of Marriage Act. Provides that the Secretary of State shall suspend, pursuant to court order, the driver's license of a person adjudicated by a court to have engaged in visitation abuse. Provides procedures for that suspension process. Provides that the court, upon finding that a party engaged in visitation abuse, may order: the suspension of the offending party's Illinois driving privileges pursuant to the Illinois Vehicle Code, until the court has determined that there has been sufficient compliance with the court's visitation order and that full driving privileges shall be reinstated; the issuance of a family responsibility driving permit to the offending party to allow limited driving privileges for employment, for medical purposes, and to transport a child pursuant to a visitation order; the placement of the offending party on probation; or the sentencing of the offending party to periodic imprisonment for up to 6 months, provided that the court may allow periods of release for work. Effective immediately.

7 | Sec. 7-707. Payment of reinstatement fee. When a person | ||||||
8 | receives
notice from the Secretary of State that the suspension | ||||||
9 | of driving privileges
has been terminated based upon (i) | ||||||
10 | receipt of notification from the circuit
clerk of the person's | ||||||
11 | compliance as obligor with a court order of
support , or (ii) | ||||||
12 | receipt of notification from the Illinois Department of | ||||||
13 | Healthcare and Family Services that the person whose driving | ||||||
14 | privileges were terminated has paid the delinquency in full or | ||||||
15 | has arranged for payment of the delinquency and the current | ||||||
16 | support obligation in a manner satisfactory to the Department |

1 | (in a case in which the person's driving privileges were | ||||||
2 | suspended upon a certification by the Department under | ||||||
3 | subsection (c) of Section 7-702), or (iii) receipt of | ||||||
4 | notification from the circuit clerk of the person's compliance | ||||||
5 | with a court order concerning visitation, the driver obligor | ||||||
6 | shall pay a $70 reinstatement fee to the
Secretary of
State as | ||||||
7 | set forth in Section 6-118 of this Code. $30 of the $70 fee
| ||||||
8 | shall be deposited
into the Family Responsibility Fund. In | ||||||
9 | accordance with subsection (e) of
Section 6-115 of this Code, | ||||||
10 | the Secretary of State may decline to process a
renewal of a | ||||||
11 | driver's license of a person who has not paid this fee.
