Bill Title: Amends the School Code. Allows a school board to waive, by resolution, any statutory or regulatory curricular mandate for which the school district does not receive a separate State appropriation through the State Board of Education or reimbursement by the State to extend the school day or year (with exceptions for special education requirements, graduation requirements, and any curricular mandate directly related to an Illinois Learning Standard). Provides that if a student requests information on any curricular mandate that has been waived, then the school district shall provide the student with the requested information. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The School Code is amended by adding Section
5 27-2.5 as follows:
6 (105 ILCS 5/27-2.5 new)
7 Sec. 27-2.5. Instructional mandate discontinuance.
8 (a) For the purposes of this Section, "instructional
9 mandate" means any State law in this Article that requires a
10 school district to devote any amount of time to the instruction
11 of or engagement by students in a subject or course.
12 (b) Notwithstanding Section 2-3.25g or any other provision
13 of this Code, a school board may discontinue, by publicly
14 adopted resolution, any instructional mandate in this Article
15 for which the school district does not receive a separate State
16 appropriation through the State Board of Education or
17 reimbursement by the State to extend the school day or year.
18 This Section, however, does not permit a school board to
19 discontinue by resolution the requirements set forth in
20 Sections 27-5, 27-6, 27-7, and 27-22 of this Code and Sections
21 27-24 through 27-24.8 of this Code.
22 (c) If a student requests information on any instructional
23 mandate that has been discontinued under this Section, then the

1 school district shall provide the student with the requested
2 information.
3 (d) The State Board of Education may adopt any rules that
4 it deems necessary for the implementation of this Section.
5 Section 99. Effective date. This Act takes effect upon
6 becoming law.
