Bill Title: Amends the Recreational Trails of Illinois Act. Provides that any person under the age of 18 who is operating an off-highway vehicle on public land, shall be trained and certified through a State-approved off-highway vehicle safety course. Provides that the minimum age to operate an off-highway vehicle on public land shall be 14 years old, and that any person under the age of 16 is prohibited from operating an off-highway vehicle on public land without direct adult supervision. Provides that unless the off-highway vehicle was designed by the manufacturer to carry a passenger, it shall be unlawful for a passenger to be on an off-highway vehicle on public land. Provides that any person operating an off-highway vehicle on public lands is required to wear a safety helmet and eye protection and the off-highway vehicle operated on public land shall have a headlight and tail light illuminated at night, brakes, a muffler, and a spark arrestor.

SYNOPSIS AS INTRODUCED:

Amends the Recreational Trails of Illinois Act. 1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Recreational Trails of Illinois Act is
5amended by adding Sections 29 and 31 as follows:
6 (20 ILCS 862/29 new)
7 Sec. 29. Training requirements for off-highway vehicles.
8Any person under the age of 18, operating an off-highway
9vehicle, as defined in Section 10 of this Act, on public land,
10shall be trained and certified through a State-approved
11off-highway vehicle safety course.
12 (20 ILCS 862/31 new)
13 Sec. 31. Use of off-highway vehicles on public lands;
14safety requirements.
15 (a) The minimum age to operate an off-highway vehicle on
16public land shall be 14 years old. Any person under the age of
1716 is prohibited from operating an off-highway vehicle on
18public land without direct adult supervision, and is prohibited
19from operating an adult sized all-terrain vehicle on public
20land.
21 (b) The sale of adult size all-terrain vehicles or other
22off-highway vehicles is prohibited for use to any person under

1the age of 16.
2 (c) Unless the off-highway vehicle was designed by the
3manufacturer to carry a passenger, it shall be unlawful for a
4passenger to be on an off-highway vehicle on public land.
5 (d) An off-highway vehicle operated on public land shall
6have a headlight and tail light illuminated at night, brakes, a
7muffler, and a spark arrestor.
8 (e) Any person operating an off-highway vehicle on public
9land shall wear a safety helmet and eye protection.
10 For the purposes of this Section, "off-highway vehicle" has
11the same meaning ascribed to it in Section 10 of this Act.
12 For the purposes of this Section, an "adult sized
13all-terrain vehicle" is an all-terrain vehicle or off-highway
14vehicle with an engine capacity greater than 90 cc.
