Bill Title: Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that the Department of Central Management Services, in conjunction with the State Employees Retirement System, shall enter into a contract with a qualified and experienced administrator to establish and conduct a State Retiree Medicare Primacy Coordination Audit and Assistance Program to identify retirees who are eligible for Medicare, but not enrolled in Medicare, and to assist those retirees in enrolling in Social Security and Medicare. Provides further duties and requirements for the program. Amends the Department of Healthcare and Family Services Law of the Civil Administrative Code of Illinois. Provides that the Department of Healthcare and Family Services shall enter into a contract with a qualified and experienced administrator to establish and conduct a Medicare Primacy Coordination Audit and Assistance Program to identify Medicaid recipients who could benefit from Social Security Disability Insurance representation that could provide them with income and ultimately Medicare benefits. Provides further duties and requirements for the program. Sets forth reporting requirements. Effective January 1, 2025.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Department of Central Management Services | |||||||||||||||||||||
5 | Law of the Civil Administrative Code of Illinois is amended by | |||||||||||||||||||||
6 | adding Section 405-545 as follows:

7 | (20 ILCS 405/405-545 new) | |||||||||||||||||||||
8 | Sec. 405-545. State Retiree Medicare Primacy Coordination | |||||||||||||||||||||
9 | Audit and Assistance Program. | |||||||||||||||||||||
10 | (a) Within 6 months after the effective date of this | |||||||||||||||||||||
11 | amendatory Act of the 103rd General Assembly, the Department | |||||||||||||||||||||
12 | of Central Management Services, in conjunction with the State | |||||||||||||||||||||
13 | Employees Retirement System, shall enter into a contract with | |||||||||||||||||||||
14 | a qualified and experienced administrator to establish and | |||||||||||||||||||||
15 | conduct a State Retiree Medicare Primacy Coordination Audit | |||||||||||||||||||||
16 | and Assistance Program to identify retirees who are eligible | |||||||||||||||||||||
17 | for Medicare, but not enrolled in Medicare, and to assist | |||||||||||||||||||||
18 | those retirees in enrolling in Social Security and Medicare. | |||||||||||||||||||||
19 | (b) The Program shall conduct an annual audit of the State | |||||||||||||||||||||
20 | Health Benefits Program for State of Illinois retirees for the | |||||||||||||||||||||
21 | purpose of identifying participants and their dependents who | |||||||||||||||||||||
22 | are eligible for Medicare under federal law. The Program shall | |||||||||||||||||||||
23 | also ensure that those retirees or their dependents who are |

1 | eligible for Medicare are enrolled in Medicare with Medicare | ||||||
2 | as their primary health care benefits coverage and the State | ||||||
3 | Health Benefits Program being the secondary provider of their | ||||||
4 | health care benefits coverage. | ||||||
5 | (c) The Program shall assist any retiree or dependent who | ||||||
6 | becomes disabled and is not enrolled in Social Security | ||||||
7 | Disability Insurance and Medicare with enrolling in and | ||||||
8 | obtaining Social Security Disability Insurance and Medicare | ||||||
9 | benefits. This assistance shall include, but not be limited | ||||||
10 | to: (i) developing communication materials to educate retirees | ||||||
11 | about Social Security Disability Insurance benefits; (ii) | ||||||
12 | performing multiple outreaches to targeted populations; (iii) | ||||||
13 | analyzing responses to determine Social Security Disability | ||||||
14 | Insurance eligibility; and (iv) representing qualified | ||||||
15 | individuals on their claim for Social Security Disability | ||||||
16 | Insurance and Medicare. | ||||||
17 | (d) The administrator shall provide the Department, the | ||||||
18 | State Employees Retirement System, and the General Assembly | ||||||
19 | with an annual report showing the number of retirees and | ||||||
20 | dependents who are transitioned to Social Security Disability | ||||||
21 | Insurance and Medicare and the amount of savings realized by | ||||||
22 | the State of Illinois.

25 | amended by adding Section 2205-45 as follows:

4 | (a) Within 6 months after the effective date of this | ||||||
5 | amendatory Act of the 103rd General Assembly, the Department | ||||||
6 | of Healthcare and Family Services shall enter into a contract | ||||||
7 | with a qualified and experienced administrator to establish | ||||||
8 | and conduct a Medicare Primacy Coordination Audit and | ||||||
9 | Assistance Program to identify Medicaid recipients who could | ||||||
10 | benefit from Social Security Disability Insurance | ||||||
11 | representation that could provide them with income and | ||||||
12 | ultimately Medicare benefits. | ||||||
13 | (b) The Program shall conduct an ongoing claims analysis | ||||||
14 | of adults receiving Medicaid for the purpose of identifying | ||||||
15 | high cost participants who may be eligible for Social Security | ||||||
16 | Disability Insurance. | ||||||
17 | (c) The Program shall assist any adult who claims | ||||||
18 | disability and Social Security eligibility to apply for and be | ||||||
19 | awarded Social Security Disability Insurance benefits and | ||||||
20 | subsequently Medicare. This assistance shall include, but not | ||||||
21 | be limited to: (i) developing communication materials to | ||||||
22 | educate Medicaid recipients about Social Security Disability | ||||||
23 | Insurance benefits; (ii) performing multiple outreaches to | ||||||
24 | populations targeted by claims analysis; (iii) analyzing | ||||||
25 | responses to determine Social Security Disability Insurance |

2 | their claim for Social Security Disability Insurance and | ||||||
3 | Medicare. | ||||||
4 | (d) The administrator shall provide the Department of | ||||||
