Bill Title: Amends the Environmental Protection Act. Requires the Environmental Protection Agency to develop rules which prohibit the disposal of materials at sanitary landfills that (i) have been approved for recycling through an Agency-issued Beneficial Use Determination and (ii) are located in a county where a Beneficial Use Determination facility for those materials has been approved. Requires the Agency to modify operating permits accordingly.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5adding Section 22.54a as follows:
6 (415 ILCS 5/22.54a new)
7 Sec. 22.54a. Disposal of asphalt roofing shingles. No owner
8or operator of a sanitary landfill that is located within a
925-mile radius of a site where asphalt roofing shingles are
10recycled under a Beneficial Use Determination (BUD) issued by
11the Agency pursuant to Section 22.54 of this Act shall accept
12for disposal loads of whole or processed asphalt roofing
13shingles. Nothing in this Section shall prohibit or restrict a
14sanitary landfill from accepting for disposal asphalt roofing
15shingles that are commingled with municipal waste, including,
16but not limited to, general construction or demolition debris.
17 The Agency shall post on its website the name and address
18of each site at which the recycling of asphalt roofing shingles
19under a BUD is approved.
20 No later than January 31 of each year, each recipient of a
21BUD for asphalt roofing shingles shall submit a report to the
22Agency that contains the following information: (i) the total
23quantity of asphalt roofing shingles received under the BUD

1during the previous calendar year; (ii) the beneficial uses
2during the previous calendar year of shingles received under
3the BUD; (iii) the total quantity of shingles used in each
4beneficial use during the previous calendar year; and (iv) the
5total quantity and disposition of any shingles received but not
6beneficially used under the BUD during the previous calendar
7year. The report must be submitted on a form and in a format
8prescribed by the Agency.
9 This Section is repealed on February 1, 2018.
