Bill Title: Amends the Environmental Protection Act. Requires the Environmental Protection Agency to develop rules which prohibit the disposal of materials at sanitary landfills that (i) have been approved for recycling through an Agency-issued Beneficial Use Determination and (ii) are located in a county where a Beneficial Use Determination facility for those materials has been approved. Requires the Agency to modify operating permits accordingly.

AMENDMENT TO SENATE BILL 2226
2 AMENDMENT NO. ______. Amend Senate Bill 2226 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Environmental Protection Act is amended by
5adding Section 22.54a as follows:
6 (415 ILCS 5/22.54a new)
7 Sec. 22.54a. Disposal of asphalt roofing shingles.
8Sanitary landfills located within a 25-mile radius of an
9asphalt shingle recycling facility approved for recycling by
10the Agency pursuant to Section 22.54 shall not accept loads of
11asphalt shingles for disposal. No approved asphalt shingle
12recycling facility may charge as a tipping fee of more than 50%
13of the average gate tipping fee for all materials accepted at
14the sanitary landfills within a 25-mile radius of the facility.
15On or before March 1 of each calendar year, each asphalt
16shingle recycling facility shall obtain a list of the gate

1tipping fees charged by the sanitary landfills located within a
225-mile radius and adjust its maximum tipping fee accordingly.
3Each asphalt shingle recycling facility must maintain, for a
4period of not less than 3 years, documentation which
5demonstrates its compliance with this Section.".
