Bill Title: Amends the Code of Civil Procedure. Provides that if a person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address, service of process may be effectuated by having the person serving the process mail a copy of the process via both regular and certified mail. Provides that service of the process shall meet the requirements of the Code set forth in Sections concerning forms of process and persons authorized to serve process; place of service; and failure to make return. Provides that the person serving the process shall execute and submit an affidavit confirming that the person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address and that the person serving the process has served the process in accordance with the new provisions.

AMENDMENT TO SENATE BILL 1724
2 AMENDMENT NO. ______. Amend Senate Bill 1724, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
5 "Section 5. The Mental Health and Developmental
6Disabilities Code is amended by changing Section 3-611 as
7follows:
8 (405 ILCS 5/3-611) (from Ch. 91 1/2, par. 3-611)
9 Sec. 3-611. Within 24 hours, excluding Saturdays, Sundays
10and holidays, after the respondent's admission under this
11Article, the facility director of the facility shall file 2
12copies of the petition, the first certificate, and proof of
13service of the petition and statement of rights upon the
14respondent with the court in the county in which the facility
15is located. Upon completion of the second certificate, the
16facility director shall promptly file it with the court and

1provide a copy to the respondent. The facility director shall
2make copies of the certificates available to the attorneys for
3the parties upon request. Upon the filing of the petition and
4first certificate, the court shall set a hearing to be held
5within 5 days, excluding Saturdays, Sundays and holidays, after
6receipt of the petition. The court shall direct that notice of
7the time and place of the hearing be served upon the
8respondent, his responsible relatives, and the persons
9entitled to receive a copy of the petition pursuant to Section
103-609.

12 Section 99. Effective date. This Act takes effect upon
