Bill Title: Amends the Code of Civil Procedure. Provides that if a person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address, service of process may be effectuated by having the person serving the process mail a copy of the process via both regular and certified mail. Provides that service of the process shall meet the requirements of the Code set forth in Sections concerning forms of process and persons authorized to serve process; place of service; and failure to make return. Provides that the person serving the process shall execute and submit an affidavit confirming that the person, corporation, or agent or officer of a corporation uses a post office box as a principal mailing address and that the person serving the process has served the process in accordance with the new provisions.

| 1 | AN ACT concerning civil law.

| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Mental Health and Developmental | ||||||
| 5 | Disabilities Code is amended by changing Section 3-611 as | ||||||
| 6 | follows:
| ||||||
| 7 | (405 ILCS 5/3-611) (from Ch. 91 1/2, par. 3-611)
| ||||||
| 8 | Sec. 3-611.
Within 24 hours, excluding Saturdays, Sundays | ||||||
| 9 | and holidays,
after the respondent's admission under this | ||||||
| 10 | Article, the facility director
of the facility shall file 2 | ||||||
| 11 | copies of the petition, the first certificate,
and proof of | ||||||
| 12 | service of the petition and statement of rights upon the | ||||||
| 13 | respondent
with the court in the county in which the facility | ||||||
| 14 | is located. Upon completion
of the second certificate, the | ||||||
| 15 | facility director shall promptly file it with
the court and | ||||||
| 16 | provide a copy to the respondent. The facility director shall | ||||||
| 17 | make copies of the certificates
available to the attorneys for | ||||||
| 18 | the parties upon request. Upon the filing
of the petition and | ||||||
| 19 | first certificate, the court shall set a hearing to
be held | ||||||
| 20 | within 5 days, excluding Saturdays, Sundays and holidays, after
| ||||||
| 21 | receipt of the petition. The court shall direct that notice of | ||||||
| 22 | the time
and place of the hearing be served upon the | ||||||
| 23 | respondent, his responsible
relatives, and the persons
| ||||||

| 1 | entitled to receive a copy of the petition pursuant to Section | ||||||
| 2 | 3-609.

| 4 | Section 99. Effective date. This Act takes effect upon | ||||||
