Bill Title: Amends the Illinois Public Aid Code. Provides that notwithstanding any law, pre-existing contract, or rule to the contrary, the Department of Healthcare and Family Services shall not enter into a contract or agreement with a managed care organization that includes any incentive for denying authorization of a requested service. Provides that for the purposes of the amendatory Act, incentives shall include, but are not limited to, incentives of any kind, including financial and material. Effective immediately.

1 | AN ACT concerning public aid.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Illinois Public Aid Code is amended by | ||||||||||||||||||||||||
5 | changing Section 5F-45 as follows:

6 | (305 ILCS 5/5F-45) | ||||||||||||||||||||||||
7 | Sec. 5F-45. Prohibition. | ||||||||||||||||||||||||
8 | (a) No managed care organization or contract shall contain | ||||||||||||||||||||||||
9 | any provision, policy, or procedure that limits, restricts, or | ||||||||||||||||||||||||
10 | waives any rights set forth in this Article or is expressly | ||||||||||||||||||||||||
11 | prohibited by this Article. Any such policy or procedure is | ||||||||||||||||||||||||
12 | void and unenforceable.
