Bill Title: Amends the Humane Care for Animals Act. Provides that if the Department of Agriculture determines that a complaint made under the Act against a person or entity is false or unfounded and made with the intent to harass the person or entity, the Department may waive any confidentiality of the complainant and refer the matter to the State's Attorney for consideration of criminal charges against the complainant. Effective immediately.

1 | AN ACT concerning animals.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Humane Care for Animals Act is amended by | ||||||
5 | adding Section 19 as follows:

6 | (510 ILCS 70/19 new) | ||||||
7 | Sec. 19. False complaints. If any law enforcement officer, | ||||||
8 | animal control officer, the Department, or an approved humane | ||||||
9 | investigator determines that a complaint made under this Act | ||||||
10 | against an animal control facility or animal shelter, or an | ||||||
11 | employee thereof, is knowingly false and not made in good faith | ||||||
12 | and is made with the intent to harass the person or entity, the | ||||||
13 | Department may waive any confidentiality of the complainant and | ||||||
14 | may refer the matter to the State's Attorney for consideration | ||||||
15 | of criminal charges against the complainant.

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.
