Bill Title: Amends the Humane Care for Animals Act. Provides that if the Department of Agriculture determines that a complaint made under the Act against a person or entity is false or unfounded and made with the intent to harass the person or entity, the Department may waive any confidentiality of the complainant and refer the matter to the State's Attorney for consideration of criminal charges against the complainant. Effective immediately.

2 | AMENDMENT NO. ______. Amend Senate Bill 1532 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Humane Care for Animals Act is amended by | ||||||
5 | adding Section 19 as follows:

6 | (510 ILCS 70/19 new) | ||||||
7 | Sec. 19. False complaints. If any law enforcement officer, | ||||||
8 | animal control officer, the Department, or an approved humane | ||||||
9 | investigator determines that a complaint made under this Act | ||||||
10 | against a person or entity is knowingly false and not made in | ||||||
11 | good faith and is made with the intent to harass the person or | ||||||
12 | entity, the Department may waive any confidentiality of the | ||||||
13 | complainant and may refer the matter to the State's Attorney | ||||||
14 | for consideration of criminal charges against the complainant.
