Bill Title: Creates the Dense Breast Tissue Act. Provides that the Act's provisions apply to a facility that provides mammography services in Illinois. Provides that if a patient's mammogram demonstrates dense breast tissue, the provider of mammography services shall provide notification to the patient in the summary of the mammography report sent to the patient that shall include specified information. Defines "dense breast tissue". Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Repeals a provision requiring the Department of Public Health to enforce provisions regarding the duty of providers of mammography services to provide specific notifications if a patient's mammogram demonstrates dense breast tissue.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Emergency Management Agency Act is | |||||||||||||||||||||
5 | amended by adding Section 10.5 as follows:

7 | Sec. 10.5. Breast cancer; duty of providers of mammography | |||||||||||||||||||||
8 | services to notify and inform. | |||||||||||||||||||||
9 | (a) As used in this Section, "dense breast tissue" means | |||||||||||||||||||||
10 | heterogeneously dense or extremely dense tissue as defined in | |||||||||||||||||||||
11 | nationally recognized guidelines or systems for breast imaging | |||||||||||||||||||||
12 | reporting of mammography screening, including, but not limited | |||||||||||||||||||||
13 | to, the Breast Imaging Reporting and Data System established by | |||||||||||||||||||||
14 | the American College of Radiology, and any equivalent new | |||||||||||||||||||||
15 | terms, as such guidelines are updated. | |||||||||||||||||||||
16 | (b) If a patient's mammogram demonstrates dense breast | |||||||||||||||||||||
17 | tissue, the Illinois Emergency Management Agency shall require | |||||||||||||||||||||
18 | every provider of mammography services to include in a summary | |||||||||||||||||||||
19 | of the mammography report sent to the patient in accordance | |||||||||||||||||||||
20 | with the federal Mammography Quality Standards Act a notice | |||||||||||||||||||||
21 | substantially similar to the following: | |||||||||||||||||||||
22 | "Your mammogram indicates you have dense breast | |||||||||||||||||||||
23 | tissue. Dense breast tissue is normal and identified on |

1 | mammograms in about 50% of women. Dense breast tissue can | ||||||
2 | make it more difficult to detect cancer on a mammogram and | ||||||
3 | may be associated with an increased risk for breast cancer. | ||||||
4 | Despite these limitations, screening mammograms have been | ||||||
5 | proven to save lives. Continue to have routine screening | ||||||
6 | mammography whether or not additional exams are suggested | ||||||
7 | for you. This information is provided to raise your | ||||||
8 | awareness of the impact of breast density on cancer | ||||||
9 | detection. For further information about dense breast | ||||||
10 | tissue, as well as other breast cancer risk factors, | ||||||
11 | contact your breast imaging health care provider.". | ||||||
12 | (c) A facility that performs mammography may update the | ||||||
13 | language in the notice under subsection (b) to reflect advances | ||||||
14 | in science and technology, as long as it continues to notify | ||||||
15 | patients about dense breast tissue and its effect on the | ||||||
16 | accuracy of mammograms and encourage patients to discuss the | ||||||
17 | issue with their health care provider. | ||||||
18 | (d) This Section does not create a duty of care or other | ||||||
19 | legal obligation beyond the duty to provide notice as set forth | ||||||
20 | in this Section.
