Bill Title: Amends the Cook County Sheriff's Merit Board Division of the Counties Code. Abolishes the current Cook County Sheriff's Merit Board. Creates the Cook County Sheriff's Merit Board to exercise all functions of the former Merit Board. Provides for the functions and operation of the Cook County Sheriff's Merit Board, including appointment, composition, powers, responsibilities, and rulemaking. Provides that the Sheriff of Cook County is solely responsible for the adjudication of all disciplinary measures against a sworn officer when the recommended punishment for the violation alleged is the suspension of the sworn officer for a period not exceeding 30 days. Effective January 1, 2018.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Counties Code is amended by changing Section | ||||||
5 | 3-7002 as follows:
| ||||||
6 | (55 ILCS 5/3-7002) (from Ch. 34, par. 3-7002)
| ||||||
7 | Sec. 3-7002. Cook County Sheriff's Merit Board. There is | ||||||
8 | created the
Cook County Sheriff's Merit Board, hereinafter | ||||||
9 | called the Board, consisting
of 7 members appointed by the | ||||||
10 | Sheriff with the advice and consent of
three-fifths of the | ||||||
11 | county
board, except that on and after the effective date of | ||||||
12 | this amendatory Act of
1997, the Sheriff may appoint 2 | ||||||
13 | additional members, with the advice and
consent of three-fifths | ||||||
14 | of the county board, at his or her discretion. Of the members | ||||||
15 | first
appointed, one shall serve until the third Monday in | ||||||
16 | March, 1965 one until the
third Monday in March, 1967, and one | ||||||
17 | until the third Monday in March, 1969. Of
the 2 additional | ||||||
18 | members first appointed under authority of this amendatory Act
| ||||||
19 | of 1991, one shall serve until the third Monday in March, 1995, | ||||||
20 | and one until
the third Monday in March, 1997.
Of the 2 | ||||||
21 | additional members first appointed under the authority of this
| ||||||
22 | amendatory Act of
the 91st General Assembly, one shall serve | ||||||
23 | until the third Monday in March,
2005 and
one shall serve until |

1 | the third Monday in March, 2006.
| ||||||
2 | Upon the expiration of the terms of office of those first | ||||||
3 | appointed
(including the 2 additional members first appointed | ||||||
4 | under authority of
this amendatory Act of 1991 and under the | ||||||
5 | authority of this amendatory Act of
the
91st General Assembly), | ||||||
6 | their respective successors shall be
appointed to hold office | ||||||
7 | from the third Monday in March of the year of
their respective | ||||||
8 | appointments for a term of 6 years and until their
successors | ||||||
9 | are appointed and qualified for a like term. As additional
| ||||||
10 | members are appointed under authority of this amendatory Act of | ||||||
11 | 1997, their
terms shall be set to be staggered consistently | ||||||
12 | with the terms of the existing
Board members. | ||||||
13 | Notwithstanding any provision in this Section to the | ||||||
14 | contrary, the term of office of each member of the Board is | ||||||
15 | abolished on the effective date of this amendatory Act of the | ||||||
16 | 100th General Assembly. Of the 7 members first appointed after | ||||||
17 | the effective date of this Act of the 100th General Assembly, 2 | ||||||
18 | shall serve until the third Monday in March 2019, 2 shall serve | ||||||
19 | until the third Monday in March 2021, and 3 members shall serve | ||||||
20 | until the third Monday in March 2023. The terms of the 2 | ||||||
21 | additional members first appointed after the effective date of | ||||||
22 | this Act of the 100th General Assembly shall be staggered | ||||||
23 | consistently with the terms of the other Board members. | ||||||
24 | Successors shall be appointed to hold office from the third | ||||||
25 | Monday in March of the year of their respective appointments | ||||||
26 | for a term of 6 years. Each member of the Board shall hold |

| |||||||
1 | office until his or her successor is appointed and qualified. | ||||||
2 | In the case of a vacancy in the office of a member prior to | ||||||
3 | the conclusion of the member's term, the Sheriff shall, with | ||||||
4 | the advice and consent of three-fifths of the county board, | ||||||
5 | appoint a person to serve for the remainder of the unexpired | ||||||
6 | term. | ||||||
7 | No more than 3
members of the Board shall be affiliated | ||||||
8 | with the same political party,
except that as additional | ||||||
9 | members are appointed by the Sheriff under authority
of this | ||||||
10 | amendatory Act of 1997 and under the authority of this | ||||||
11 | amendatory Act
of the 91st General Assembly , the political | ||||||
12 | affiliation of the Board shall be
such that no more than | ||||||
13 | one-half of the members plus one additional member may
be | ||||||
14 | affiliated with the same political party. No member shall have | ||||||
15 | held or have
been a candidate for an elective public office | ||||||
16 | within one year preceding his or
her appointment.

17 | The Sheriff may deputize members of the Board.

20 | Section 99. Effective date. This Act takes effect upon | ||||||
21 | becoming law.
