Bill Title: Authorizes the Director of the Department of Natural Resources to deliver a quitclaim deed for a portion of real property in Peoria County to the Village of Dunlap for $1, subject to specified conditions. Amends Public Act 86-729. Provides that the property may also be used for a private drug addiction treatment center. Amends the Counties Code. Allows the operation of a private drug addiction treatment center on the property transferred to Kane County in Public Act 86-729. Provides that Kane County may lease portions of the property transferred to Kane County to a not-for-profit or for-profit company for a drug addiction treatment center and share in the drug addiction treatment center revenue. Provides that Kane County may authorize the expenditure of funds for a private drug addiction treatment center on the property transferred to the County. Amends Public Act 89-29 and Public Act 89-78, which included identical provisions authorizing the conveyance of certain property to Kreider Services, Inc., subject to certain conditions. Provides that Kreider Services, Inc. may convey the land by quitclaim deed to another party, subject to the condition that if the land is no longer used for the purpose of offering services to individuals with developmental disabilities or behavioral health needs, or both, the land shall revert to ownership by the State of Illinois. Makes corresponding changes. Effective immediately.

1 AN ACT concerning property.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Director of the Department of Natural
5Resources, on behalf of the State of Illinois, is authorized
6to execute and deliver to the Village of Dunlap, a
7municipality organized and existing under the laws of the
8State of Illinois, of Peoria County, State of Illinois, for
9and in consideration of $1 paid to the Department, a quitclaim
10deed to the following described real property, to wit:
11 That part of the Chicago, Rock Island and Pacific Railroad
12 Company's abandoned right of way conveyed to the State of
13 Illinois, Department of Conservation (now the Department
14 of Natural Resources) by Quit-Claim Deed, recorded July 8,
15 1969 as Document No. 69-09735 lying East of the West right
16 of way line of North Third Avenue, Village of Dunlap and
17 North of the South right of way line of East Ash Street,
18 Village of Dunlap all in the Northwest Quarter of Section
19 11, Township 10 North, Range 7 East of the Fourth
20 Principal Meridian, County of Peoria, State of Illinois.
21 Section 10. The conveyance of real property authorized by
22Section 5 shall be made subject to: (1) existing public

1utilities, existing public roads, and any and all
2reservations, easements, encumbrances, covenants, and
3restrictions of record; and (2) the express condition that if
4the real property ceases to be used for public purposes, it
5shall revert to the State of Illinois, Department of Natural
6Resources.
7 Section 15. The Director of Natural Resources shall obtain
8a certified copy of this Act within 60 days after its effective
9date and, upon receipt of the payment required by Section 5,
10shall record the certified document in the Recorder's Office
11in the County in which the land is located.
12 Section 20. "An Act authorizing the Director of
13Corrections to convey State property in Kane County", Public
14Act 86-729, approved September 1, 1989, is amended by changing
15Sections 1 and 2 as follows:
16 (P.A. 86-729, Sec. 1)
17 Sec. 1. Upon payment of the sum of $1,017,000 to the
18Department of Corrections, and subject to the conditions set
19forth in Sections 2 and 3 of this Act, the Director of
20Corrections is authorized to convey by quit claim deed to the
21County of Kane all right, title and interest of the State in
22and to the following described land in Kane County, Illinois,
23so long as the land is used as provided in Section 2 of this

1Act for a criminal courts complex and for no other purpose by
2the County of Kane:
3 That part of the Southeast Quarter of Section 31 and part
4 of the North Half of the Southwest Quarter of Section 32,
5 Township 40 North, Range 8 East of the Third Principal
6 Meridian described as follows: Commencing at the Southeast
7 corner of the Northeast Quarter of said Section 32; thence
8 South 88>34' West 1331.90 feet; thence South 0>19' East
9 521.20 feet to the center line of the former St. Charles
10 and Elburn Road; thence South 87>26' West 1764.0 feet;
11 thence North 1>13' East 539.88 feet to the North line of
12 said North Half for a point of beginning; thence Westerly
13 along said North line and said North line extended 2202.84
14 feet to the center line of Peck Road; thence Southerly
15 along the center line of said Peck Road 524.31 feet to a
16 line drawn parallel with and 60 feet Northerly of the
17 center line (measured at right angles thereto) of Federal
18 Aid Route 7 (Illinois State Route No. 38); thence Easterly
19 along said parallel line 2173.59 feet to a line drawn
20 South 1>13' West from the point of beginning; thence North
21 1>13' East 476.14 feet to the point of beginning, in St.
22 Charles Township, Kane County, Illinois and containing
23 24.931 acres;

25 That part of the North Half of the Southwest Quarter of
26 Section 32, Township 40 North, Range 8 East of the Third

1 Principal Meridian described as follows: Beginning at the
2 Southeast corner of said Half; thence Northerly along the
3 East line of said Half 737.83 feet to a line drawn parallel
4 with and 60.0 feet Southerly of the center line (measured
5 at right angles thereto) of Federal Aid Route 7 (Illinois
6 State Route No. 38); thence Westerly along said parallel
7 line 2637.26 feet to the center line of Peck Road; thence
8 Southerly along the center line of said Peck Road 678.16
9 feet to the Southwest corner of said North Half; thence
10 Easterly along the South line of said Half 2641.49 feet to
11 the point of beginning, in St. Charles Township, Kane
12 County, Illinois and containing 42.860 acres.

15 Sec. 2. It is understood and agreed as part of the
16consideration hereof that no other use shall be permitted now
17or in the future by the County of Kane for the premises
18described in Section 1 of this Act other than (i) that of a
19criminal courts complex and (ii) a private drug addiction
20treatment center and that language establishing a defeasible
21fee on that condition subsequent shall be placed in the quit
22claim deed conveying said property.

24 Section 25. The Counties Code is amended by adding Section

15-1186 as follows:
2 (55 ILCS 5/5-1186 new)
3 Sec. 5-1186. Kane County criminal courts complex drug
4treatment center. Notwithstanding any other provision of law:
5 (1) A private drug addiction treatment center may
6 operate on the property transferred to Kane County in
7 Public Act 86-729.
8 (2) Kane County may lease portions of the property
9 transferred to the County in Public Act 86-729 to a
10 not-for-profit or for-profit company for a drug addiction
11 treatment center. Kane County may share in the drug
12 addiction treatment center revenue with a company to whom
13 it leases the property.
14 (3) Kane County may authorize the expenditure of funds
15 for a private drug addiction treatment center on the
16 property transferred to the County in Public Act 86-729.
17 Section 30. "An Act in relation to governmental matters",
18approved June 23, 1995, Public Act 89-29, is amended by
19changing Section 1-95 as follows:
20 (P.A. 89-29, Sec. 1-95)
21 Sec. 1-95. The Illinois Department of Mental Health and
22Developmental Disabilities, on behalf of the State of
23Illinois, is authorized and directed to transfer and convey at

1a price of $1.00, by the execution of a Quit Claim Deed, to the
2Kreider Services, Inc. an Illinois Not for Profit Corporation,
3the following described real property, all in Lee County,
4Illinois:
5 Part of the East Half of the East Half of the Southeast
6 Quarter of Section 29, Township 22 North, Range 9 East of
7 the Fourth Principal Meridian, described as follows:
8 Beginning at a point on the West line of the said East Half
9 of the East Half, 514 feet South of the Northwest corner
10 thereof; thence East 264 feet, thence South 200 feet,
11 thence West 264 feet to the said West line, thence North on
12 the said West line to the said point of beginning.
13 Part of the Northwest Quarter of Section 33, Township
14 22 North, Range 9 East of the Fourth Principal Meridian.
15 Lee County, Illinois and part of Block 7 in the Town of
16 North Dixon, now a part of the City of Dixon, Lee County,
17 Illinois described as follows: Beginning at a point on the
18 Westerly line of said Block 7, 110.0 feet Northerly of the
19 inter-section of the said Westerly line of Block 7 with
20 the Northerly line of Graham Street extended Easterly;
21 thence Northeasterly on the Northerly line of the Lee
22 County Housing Authority property at an angle or 89° 51'
23 measured counterclockwise from the said Westerly line of
24 Block 7, 765.29 feet to the North line of said Section 33;
25 thence West on the said North line of Section 33, 207.81
26 feet to the Northwest corner of said Section 33, thence

1 West on the North line of Section 32 in aforesaid Township
2 and Range, 596.86 feet to the Northwest corner of said
3 Block 7; thence Southeasterly on the said Westerly line of

5 containing 2.15 Acres more or less.
6 Kreider shall agree to save and hold harmless the State of
7Illinois against all claims of whatever nature arising from or
8in consequence of the sale of lands herein described.
9 The instrument or instruments of conveyance shall be filed
10for record in the Office of the Recorder of Deeds of Lee County
11by Kreider within 15 days after the delivery of the instrument
12or instruments or conveyance.
13 Kreider shall agree that the land conveyed, as described
14in this Section, shall be used for the purpose of offering
15services to individuals with developmental disabilities or
16behavioral health needs, or both, Developmental Disabilities
17pursuant to Kreider's Articles of Incorporation including, but
18not limited to, Sheltered Workshop, Work Activity, Adult Day
19Training, Residential, and Services for individuals from birth
20to three years of age and if not used for these purposes or if
21Kreider's use for these purposes is discontinued, or if
22Kreider shall convey or attempt to convey all or any portion of
23the land to another party, the land shall revert to ownership
24by the State of Illinois. Kreider may convey by quitclaim deed
25all or any portion of the land to another party, subject to the
26condition that if the land is no longer used for the purpose of

1offering services to individuals with developmental
2disabilities or behavioral health needs, or both, the land
3shall revert to ownership by the State of Illinois. Any deed or
4deeds executed under this Article shall include appropriate
5provisions to effectuate the purpose of this Section.
6 Upon payment of the purchase price of $1.00, the Director
7of the Department of Mental Health and Developmental
8Disabilities shall execute and deliver a quit claim deed to
9Kreider Services, Inc. and deposit the purchase price in the
10General Revenue Fund in the State Treasury.

12 Section 35. "An Act concerning governmental matters,
13amending named Acts", approved June 30, 1995, Public Act
1489-78, is amended by changing Section 30-95 as follows:

16 Sec. 30-95. The Illinois Department of Mental Health and
17Developmental Disabilities, on behalf of the State of
18Illinois, is authorized and directed to transfer and convey at
19a price of $1.00, by the execution of a Quit Claim Deed, to the
20Kreider Services, Inc. an Illinois Not for Profit Corporation,
21the following described real property, all in Lee County,
22Illinois:
23 Part of the East Half of the East Half of the Southeast
