Bill Title: If and only if Senate Bill 2925 of the 100th General Assembly becomes law (in the form in which it passed both houses), amends the Illinois Police Training Act to provide that the Illinois Law Enforcement Training Standards Board may offer a school resource officer course to a qualified retired law enforcement officer. Provides that nothing in the school resource officer course provision prohibits a school resource officer or qualified retired law enforcement officer from carrying a firearm. If and only if Senate Bill 2925 of the 100th General Assembly becomes law (in the form in which it passed both houses), amends the School Code. Provides that beginning January 1, 2021, a school or school district may employ a qualified retired law enforcement officer who obtains a certificate of completion or approved waiver under the Illinois Police Training Act to carry out the duties of a school resource officer. Makes a conforming change. Effective immediately or on the date Senate Bill 2925 of the 100th General Assembly takes effect, whichever is later.

1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. If and only if Senate Bill 2925 of the 100th | |||||||||||||||||||||
5 | General Assembly becomes law in the form in which it passed | |||||||||||||||||||||
6 | both houses on May 25, 2018, then the Illinois Police Training | |||||||||||||||||||||
7 | Act is amended by changing Section 10.22 as follows:

9 | Sec. 10.22. School resource officer. | |||||||||||||||||||||
10 | (a) The Board shall develop or approve a course for school | |||||||||||||||||||||
11 | resource officers as defined in Section 10-20.67 of the School | |||||||||||||||||||||
12 | Code. | |||||||||||||||||||||
13 | (b) The school resource officer course shall be developed | |||||||||||||||||||||
14 | within one year after the effective date of this amendatory Act | |||||||||||||||||||||
15 | of the 100th General Assembly and shall be created in | |||||||||||||||||||||
16 | consultation with organizations demonstrating expertise and or | |||||||||||||||||||||
17 | experience in the areas of youth and adolescent developmental | |||||||||||||||||||||
18 | issues, educational administrative issues, prevention of child | |||||||||||||||||||||
19 | abuse and exploitation, youth mental health treatment, and | |||||||||||||||||||||
20 | juvenile advocacy. | |||||||||||||||||||||
21 | (c) The Board shall develop a process allowing law | |||||||||||||||||||||
22 | enforcement agencies to request a waiver of this training | |||||||||||||||||||||
23 | requirement for any specific individual assigned as a school |

1 | resource officer. Applications for these waivers may be | ||||||
2 | submitted by a local law enforcement agency chief administrator | ||||||
3 | for any officer whose prior training and experience may qualify | ||||||
4 | for a waiver of the training requirement of this subsection | ||||||
5 | (c). The Board may issue a waiver at its discretion, based | ||||||
6 | solely on the prior training and experience of an officer. | ||||||
7 | (d) Upon completion, the employing agency shall be issued a | ||||||
8 | certificate attesting to a specific officer's completion of the | ||||||
9 | school resource officer training. Additionally, a letter of | ||||||
10 | approval shall be issued to the employing agency for any | ||||||
11 | officer who is approved for a training waiver under this | ||||||
12 | subsection (d). | ||||||
13 | (e) The Board may offer the school resource officer course | ||||||
14 | developed under this Section to a qualified retired law | ||||||
15 | enforcement officer, as defined under the federal Law | ||||||
16 | Enforcement Officers Safety Act of 2004, for the purpose of | ||||||
17 | employment at a school or school district and may issue, for | ||||||
18 | such purpose, a certificate or waiver in the same manner as | ||||||
19 | provided under this Section for any other officer. | ||||||
20 | (f) Notwithstanding any other provision of law to the | ||||||
21 | contrary, nothing in this Section prohibits a school resource | ||||||
22 | officer or qualified retired law enforcement officer from | ||||||
23 | carrying a firearm.

6 | (a) In this Section, "school resource officer" means a law | ||||||
7 | enforcement officer who has been primarily assigned to a school | ||||||
8 | or school district under an agreement with a local law | ||||||
9 | enforcement agency. | ||||||
10 | (b) Beginning January 1, 2021, any law enforcement agency | ||||||
11 | that provides a school resource officer under this Section | ||||||
12 | shall provide to the school district a certificate of | ||||||
13 | completion, or approved waiver, issued by the Illinois Law | ||||||
14 | Enforcement Training Standards Board under Section 10.22 of the | ||||||
15 | Illinois Police Training Act indicating that the subject | ||||||
16 | officer has completed the requisite course of instruction in | ||||||
17 | the applicable subject areas within one year of assignment, or | ||||||
18 | has prior experience and training which satisfies this | ||||||
19 | requirement. | ||||||
20 | (c) In an effort to defray the related costs, any law | ||||||
21 | enforcement agency that provides a school resource officer | ||||||
22 | should apply for grant funding through the federal Community | ||||||
23 | Oriented Policing Services grant program. | ||||||
24 | (d) Beginning January 1, 2021, a school or school district | ||||||
25 | may employ a qualified retired law enforcement officer, as |

10 | Section 99. Effective date. This Act takes effect upon | ||||||
11 | becoming law or on the date Senate Bill 2925 of the 100th | ||||||
12 | General Assembly takes effect, whichever is later.
