Bill Title: Amends various Acts relating to the governance of public universities in Illinois. With respect to in-state tuition charges, provides that a person who is honorably discharged from the armed forces of the United States shall be granted immediate classification as an in-state student on honorable discharge from the armed forces and, while in continuous attendance toward the degree for which he or she is currently enrolled, does not lose in-state student classification if the person has registered to vote in this State and has demonstrated objective evidence of an intent to be a resident of this State, which includes at least (i) an Illinois driver's license, (ii) Illinois motor vehicle registration, (iii) an employment history in this State, (iv) the transfer of major banking services to this State, (v) a change of permanent address on all pertinent records, or (vi) other materials of whatever kind or source relevant to domicile or residency status.

Amends various Acts relating to the governance of public universities in Illinois. 1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The University of Illinois Act is amended by
5changing Section 7e-5 as follows:
6 (110 ILCS 305/7e-5)
7 Sec. 7e-5. In-state tuition charge.
8 (a) Notwithstanding any other provision of law to the
9contrary, for tuition purposes, the Board of Trustees shall
10deem an individual an Illinois resident, until the individual
11establishes a residence outside of this State, if all of the
12following conditions are met:
13 (1) The individual resided with his or her parent or
14 guardian while attending a public or private high school in
15 this State.
16 (2) The individual graduated from a public or private
17 high school or received the equivalent of a high school
18 diploma in this State.
19 (3) The individual attended school in this State for at
20 least 3 years as of the date the individual graduated from
21 high school or received the equivalent of a high school
22 diploma.
23 (4) The individual registers as an entering student in

1 the University not earlier than the 2003 fall semester.
2 (5) In the case of an individual who is not a citizen
3 or a permanent resident of the United States, the
4 individual provides the University with an affidavit
5 stating that the individual will file an application to
6 become a permanent resident of the United States at the
7 earliest opportunity the individual is eligible to do so.
8 This subsection (a) applies only to tuition for a term or
9semester that begins on or after May 20, 2003 (the effective
10date of Public Act 93-7). Any revenue lost by the University in
11implementing this subsection (a) shall be absorbed by the
12University Income Fund.
13 (b) If a person is on active military duty and stationed in
14Illinois, then the Board of Trustees shall deem that person and
15any of his or her dependents Illinois residents for tuition
16purposes. Beginning with the 2009-2010 academic year, if a
17person is on active military duty and is stationed out of
18State, but he or she was stationed in this State for at least 3
19years immediately prior to being reassigned out of State, then
20the Board of Trustees shall deem that person and any of his or
21her dependents Illinois residents for tuition purposes, as long
22as that person or his or her dependent (i) applies for
23admission to the University within 18 months of the person on
24active military duty being reassigned or (ii) remains
25continuously enrolled at the University.
26 (c) With respect to in-state tuition charges, a person who

24Act is amended by changing Section 8d-5 as follows:

16Board shall deem that person and any of his or her dependents
17Illinois residents for tuition purposes, as long as that person
18or his or her dependent (i) applies for admission to the
19University within 18 months of the person on active military
20duty being reassigned or (ii) remains continuously enrolled at
21the University.
22 (c) With respect to in-state tuition charges, a person who
23is honorably discharged from the armed forces of the United
24States shall be granted immediate classification as an in-state
25student on honorable discharge from the armed forces and, while
26in continuous attendance toward the degree for which he or she

1is currently enrolled, does not lose in-state student
2classification if the person has met the following
3requirements:
4 (1) Has registered to vote in this State.
5 (2) Has demonstrated objective evidence of an intent to
6 be a resident of this State, which, for the purposes of
7 this subsection (c), includes at least one of the
8 following:
9 (A) An Illinois driver's license.
10 (B) Illinois motor vehicle registration.
11 (C) Employment history in this State.
12 (D) Transfer of major banking services to this
13 State.
14 (E) A change of permanent address on all pertinent
15 records.
16 (F) Other materials of whatever kind or source
17 relevant to domicile or residency status.

19 Section 45. The Western Illinois University Law is amended
20by changing Section 35-88 as follows:
21 (110 ILCS 690/35-88)
22 Sec. 35-88. In-state tuition charge.
23 (a) Notwithstanding any other provision of law to the
24contrary, for tuition purposes, the Board shall deem an

1individual an Illinois resident, until the individual
2establishes a residence outside of this State, if all of the
3following conditions are met:
4 (1) The individual resided with his or her parent or
5 guardian while attending a public or private high school in
6 this State.
7 (2) The individual graduated from a public or private
8 high school or received the equivalent of a high school
9 diploma in this State.
10 (3) The individual attended school in this State for at
11 least 3 years as of the date the individual graduated from
12 high school or received the equivalent of a high school
13 diploma.
14 (4) The individual registers as an entering student in
15 the University not earlier than the 2003 fall semester.
16 (5) In the case of an individual who is not a citizen
17 or a permanent resident of the United States, the
18 individual provides the University with an affidavit
19 stating that the individual will file an application to
20 become a permanent resident of the United States at the
21 earliest opportunity the individual is eligible to do so.
22 This subsection (a) applies only to tuition for a term or
23semester that begins on or after May 20, 2003 (the effective
24date of Public Act 93-7). Any revenue lost by the University in
25implementing this subsection (a) shall be absorbed by the
26University Income Fund.

1 (b) If a person is on active military duty and stationed in
2Illinois, then the Board shall deem that person and any of his
3or her dependents Illinois residents for tuition purposes.
4Beginning with the 2009-2010 academic year, if a person is on
5active military duty and is stationed out of State, but he or
6she was stationed in this State for at least 3 years
7immediately prior to being reassigned out of State, then the
8Board shall deem that person and any of his or her dependents
9Illinois residents for tuition purposes, as long as that person
10or his or her dependent (i) applies for admission to the
11University within 18 months of the person on active military
12duty being reassigned or (ii) remains continuously enrolled at
13the University.
14 (c) With respect to in-state tuition charges, a person who
15is honorably discharged from the armed forces of the United
16States shall be granted immediate classification as an in-state
17student on honorable discharge from the armed forces and, while
18in continuous attendance toward the degree for which he or she
19is currently enrolled, does not lose in-state student
20classification if the person has met the following
21requirements:
22 (1) Has registered to vote in this State.

25 this subsection (c), includes at least one of the
