Bill Title: Amends the Illinois Vehicle Code. Provides that the Secretary of State shall issue distinctive registration plates for covered farm vehicles. Provides that a $10 surcharge shall be collected, in addition to all applicable fees, for the issuance of a registration plate. Provides that the surcharge shall be deposited into the Secretary of State Special License Plate Fund. Provides that a designation as a covered farm vehicle shall not limit the purposes for which that vehicle may otherwise be used. Makes a corresponding change to the definition of "covered farm vehicle". Effective immediately.

Amends the Illinois Vehicle Code. Provides that the Secretary of State shall issue distinctive registration plates for covered farm vehicles. Provides that the surcharge shall be deposited into the Secretary of State Special License Plate Fund. Provides that a designation as a covered farm vehicle shall not limit the purposes for which that vehicle may otherwise be used. Modifies the definition of "covered farm vehicle". 1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by changing
5Sections 3-412 and 18b-101 as follows:
6 (625 ILCS 5/3-412) (from Ch. 95 1/2, par. 3-412)
7 Sec. 3-412. Registration plates and registration stickers
8to be furnished by the Secretary of State.
9 (a) The Secretary of State upon registering a vehicle
10subject to annual registration for the first time shall issue
11or shall cause to be issued to the owner one registration plate
12for a motorcycle, trailer, semitrailer, moped, autocycle, or
13truck-tractor, 2 registration plates for other motor vehicles
14and, where applicable, current registration stickers for motor
15vehicles of the first division. The provisions of this Section
16may be made applicable to such vehicles of the second division,
17as the Secretary of State may, from time to time, in his
18discretion designate. On subsequent annual registrations
19during the term of the registration plate as provided in
20Section 3-414.1, the Secretary shall issue or cause to be
21issued registration stickers as evidence of current
22registration. However, the issuance of annual registration
23stickers to vehicles registered under the provisions of

1Sections 3-402.1 and 3-405.3 of this Code may not be required
2if the Secretary deems the issuance unnecessary.
3 (b) Every registration plate shall have displayed upon it
4the registration number assigned to the vehicle for which it is
5issued, the name of this State, which may be abbreviated, the
6year number for which it was issued, which may be abbreviated,
7the phrase "Land of Lincoln" (except as otherwise provided in
8this Code), and such other letters or numbers as the Secretary
9may prescribe. However, for apportionment plates issued to
10vehicles registered under Section 3-402.1 and fleet plates
11issued to vehicles registered under Section 3-405.3, the phrase
12"Land of Lincoln" may be omitted to allow for the word
13"apportioned", the word "fleet", or other similar language to
14be displayed. Registration plates issued to a vehicle
15registered as a fleet vehicle may display a designation
16determined by the Secretary.
17 The Secretary may in his discretion prescribe that letters
18be used as prefixes only on registration plates issued to
19vehicles of the first division which are registered under this
20Code and only as suffixes on registration plates issued to
21other vehicles. Every registration sticker issued as evidence
22of current registration shall designate the year number for
23which it is issued and such other letters or numbers as the
24Secretary may prescribe and shall be of a contrasting color
25with the registration plates and registration stickers of the
26previous year.

1 (c) Each registration plate and the required letters and
2numerals thereon, except the year number for which issued,
3shall be of sufficient size to be plainly readable from a
4distance of 100 feet during daylight, and shall be coated with
5reflectorizing material. The dimensions of the plate issued to
6vehicles of the first division shall be 6 by 12 inches.
7 (d) The Secretary of State shall issue for every passenger
8motor vehicle rented without a driver the same type of
9registration plates as the type of plates issued for a private
10passenger vehicle.
11 (e) The Secretary of State shall issue for every passenger
12car used as a taxicab or livery, distinctive registration
13plates.
14 (f) The Secretary of State shall issue for every motorcycle
15distinctive registration plates distinguishing between
16motorcycles having 150 or more cubic centimeters piston
17displacement, or having less than 150 cubic centimeter piston
18displacement.
19 (g) Registration plates issued to vehicles for-hire may
20display a designation as determined by the Secretary that such
21vehicles are for-hire.
22 (h) (Blank).
23 (i) The Secretary of State shall issue for every public and
24private ambulance registration plates identifying the vehicle
25as an ambulance. The Secretary shall forward to the Department
26of Healthcare and Family Services registration information for

1the purpose of verification of claims filed with the Department
2by ambulance owners for payment for services to public
3assistance recipients.
4 (j) The Secretary of State shall issue for every public and
5private medical carrier or rescue vehicle livery registration
6plates displaying numbers within ranges of numbers reserved
7respectively for medical carriers and rescue vehicles. The
8Secretary shall forward to the Department of Healthcare and
9Family Services registration information for the purpose of
10verification of claims filed with the Department by owners of
11medical carriers or rescue vehicles for payment for services to
12public assistance recipients.
13 (k) The Secretary of State shall issue distinctive license
14plates or distinctive license plate stickers for every vehicle
15exempted from subsections (a) and (a-5) of Section 12-503 by
16subsection (g) of that Section, and by subsection (g-5) of that
17Section before its deletion by this amendatory Act of the 95th
18General Assembly. The Secretary shall issue these plates or
19stickers immediately upon receiving the physician's
20certification required under subsection (g) of Section 12-503.
21New plates or stickers shall also be issued when the
22certification is renewed as provided in that subsection.
23 (l) The Secretary of State shall issue distinctive
24registration plates for low-speed vehicles.
25 (m) The Secretary of State shall issue distinctive
26registration plates for autocycles. The dimensions of the plate

1issued to autocycles shall be 4 by 7 inches.
2 (n) The Secretary of State shall issue distinctive
3registration plates for covered farm vehicles as defined in
4Section 18b-101 of this Code. The owner of a motor vehicle
5weighing 8,000 pounds or less who obtains a special
6registration plate under this subsection (n) shall be assessed
7a $10 surcharge in addition to all applicable fees prescribed
8by the Secretary for the issuance of registration plates under
9this Code. The $10 surcharge collected under this subsection
10(n) shall be deposited into the Secretary of State Special
11License Plate Fund. The $10 surcharge is an annual fee that
12shall be based on an applicant's new or existing registration
13year for each vehicle displaying a registration plate issued
14under this subsection (n). A designation as a covered farm
15vehicle under this subsection (n) shall not limit the purposes
16for which that vehicle may otherwise be used. The Secretary
17shall adopt any rules necessary to implement this subsection
18(n).

21 Sec. 18b-101. Definitions. Unless the context otherwise
22clearly requires, as used in this Chapter:
23 "Agricultural commodities" means any agricultural
24commodity, non-processed food, feed, fiber, or livestock,
25including insects.

1 "Agricultural operations" means the operation of a motor
2vehicle or combination of vehicles transporting agricultural
3commodities or farm supplies for agricultural purposes.
4 "Air mile" means a nautical mile, which is equivalent to
56,076 feet or 1,852 meters. Accordingly, 100 air miles are
6equivalent to 115.08 statute miles or 185.2 kilometers.
7 "Commercial motor vehicle" means any self propelled or
8towed vehicle used on public highways in interstate and
9intrastate commerce to transport passengers or property when
10the vehicle has a gross vehicle weight, a gross vehicle weight
11rating, a gross combination weight, or a gross combination
12weight rating of 10,001 or more pounds; or the vehicle is used
13or designed to transport more than 15 passengers, including the
14driver; or the vehicle is designed to carry 15 or fewer
15passengers and is operated by a contract carrier transporting
16employees in the course of their employment on a highway of
17this State; or the vehicle is used or designed to transport
18between 9 and 15 passengers, including the driver, for direct
19compensation; or the vehicle is used in the transportation of
20hazardous materials in a quantity requiring placarding under
21the Illinois Hazardous Materials Transportation Act. This
22definition shall not include farm machinery, fertilizer
23spreaders, and other special agricultural movement equipment
24described in Section 3-809 nor implements of husbandry as
25defined in Section 1-130.
26 "Covered farm vehicle", for purposes of this Chapter and

1rule-making under this Chapter, means a straight truck or
2articulated vehicle, excluding vehicles transporting hazardous
3materials of a type or quantity that requires the vehicle to be
4placarded in accordance with the Illinois Hazardous Materials
5Transportation Act, registered in this State or another state
6and equipped with a special license plate or other designation
7by the state in which the vehicle is registered identifying the
8vehicle as a covered farm vehicle for law enforcement personnel
9and:
10 (1) is operated by a farm or ranch owner or operator,
11 or an employee or family member of the farm or ranch owner
12 or operator; and
13 (2) is being used to transport the following to or from
14 a farm or ranch:
15 (A) agricultural commodities;
16 (B) livestock; or
17 (C) machinery or supplies; and
18 (3) if registered in this State, is:
19 (A) registered as a farm truck under subsection (c)
20 of Section 3-815 of this Code; or
21 (B) operated in combination as an articulated
22 vehicle when the truck in the combination is registered
23 for 12,000 lbs. or less as a covered farm vehicle under
24 subsections (a) and (a-5) of Section 3-815 of this Code
25 or subsection (a) of Section 3-818 of this Code and
26 contains in the cab of the motor vehicle a registration

1 designating the vehicle as a covered farm vehicle under
2 subsections (a) and (a-5) of Section 3-815 of this Code
3 and the trailer in the combination is registered as a
4 farm trailer under subsection (a) of Section 3-819 of
5 this Code and displays a farm registration license
6 plate; or
7 (C) a truck registered for 12,000 lbs. or less as a
8 covered farm vehicle under subsections (a) and (a-5) of
9 Section 3-815 of this Code or subsection (a) of Section
10 3-818 of this Code containing in the cab of the motor
11 vehicle a registration designating the vehicle as a
12 covered farm vehicle under subsections (a) and (a-5) of
13 Section 3-815 of this Code that is towing an implement
14 of husbandry as part of a farming operation; or and
15 (D) a motor vehicle of the second division weighing
16 8,000 pounds or less with a registration plate issued
17 under subsection (n) of Section 3-412 of this Code
18 containing in the cab of the motor vehicle a
19 registration designating the vehicle as a covered farm
20 vehicle; and
21 (4) is not used in for-hire motor carrier operations;
22 however, for-hire motor carrier operations do not include
23 the operation of a vehicle meeting the definition of a
24 covered farm vehicle by a tenant pursuant to a crop share
25 farm lease agreement to transport the landlord's portion of
26 the crops under that agreement; and

1 (5) has a gross vehicle weight rating (GVWR), a gross
2 combination weight rating (GCWR), or a gross vehicle weight
3 or gross vehicle combination weight, whichever is greater,
4 that is:
5 (A) 26,001 lbs. or less, for vehicles operating in
6 interstate commerce; or
7 (B) greater than 26,001 lbs., operating in
8 interstate commerce and registered in this State; or
9 (C) greater than 26,001 lbs. and traveling
10 interstate within 150 air miles of the farm or ranch
11 for which the vehicle is being operated, regardless of
12 whether it is registered in this State; or
13 (D) greater than 10,000 lbs. and traveling
14 intrastate.
15 "Direct compensation" means payment made to the motor
16carrier by the passengers or a person acting on behalf of the
17passengers for the transportation services provided, and not
18included in a total package charge or other assessment for
19highway transportation services.
20 "Farm supplies for agricultural purposes" means products
21directly related to the growing or harvesting of agricultural
22commodities and livestock feed at any time of the year.
23 "Livestock" means cattle, sheep, goats, swine, poultry
24(including egg-producing poultry), fish used for food, and
25other animals designated by the Secretary of the United States
26Department of Transportation (at his or her sole discretion)

1that are part of a foundation herd (including producing dairy
2cattle) or offspring.
3 "Officer" means Illinois State Police Officer.
4 "Person" means any natural person or individual,
5governmental body, firm, association, partnership,
6copartnership, joint venture, company, corporation, joint
7stock company, trust, estate or any other legal entity or their
8legal representative, agent or assigns.

10 Section 99. Effective date. This Act takes effect upon
11becoming law.
