Bill Title: Amends the Illinois Vehicle Code. Provides that every insurance company or surety company authorized to do business in this State shall collect a surcharge of $1 for each liability insurance policy issued which complies with statutory minimum coverage requirements. Provides that the surcharge shall be deposited into the into the Illinois Law Enforcement Alarm Systems Fund and used as follows: (i) 66.6% shall be used for homeland security initiatives and (ii) 33.3% shall be used for airborne operations. Provides that Illinois Law Enforcement Alarm Systems Executive Board shall annually supply the Director of State Police with a report of the use of the surcharges. Exempts units of government and nonprofit organizations from the new provisions. Effective January 1, 2013.

AMENDMENT TO HOUSE BILL 5555
2 AMENDMENT NO. ______. Amend House Bill 5555 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Intergovernmental Cooperation Act is
5amended by changing Section 2 as follows:
6 (5 ILCS 220/2) (from Ch. 127, par. 742)
7 Sec. 2. Definitions. For the purpose of this Act:
8 (1) The term "public agency" shall mean any unit of local
9government as defined in the Illinois Constitution of 1970, any
10school district, any public community college district, any
11public building commission, the State of Illinois, any agency
12of the State government or of the United States, or of any
13other State, any political subdivision of another State, and
14any combination of the above pursuant to an intergovernmental
15agreement which includes provisions for a governing body of the
16agency created by the agreement.

1 For the purposes of this Act, "public agency" includes:
2 (A) the Mid-America Intermodal Authority Port District
3 created under the Mid-America Intermodal Authority Port
4 District Act; and
5 (B) the Illinois Law Enforcement Alarm System.
6 (2) The term "state" shall mean a state of the United
7States.

9 Section 10. The Illinois Vehicle Code is amended by adding
10Section 7-601.5 as follows:
11 (625 ILCS 5/7-601.5 new)
12 Sec. 7-601.5. Illinois Law Enforcement Alarm Systems
13insurance surcharge.
14 (a) Every insurance company or surety company authorized to
15do business in this State shall collect an annual surcharge of
16$1 for each vehicle covered by a liability insurance policy
17issued in accordance with Section 7-601 of this Code. The
18surcharge shall be collected at the same time and in the same
19manner that the premium or other charge for the insurance
20coverage is collected.
21 (b) Each month, the insurer shall remit all surcharge
22moneys collected to the Treasurer for deposit into the Illinois
23Law Enforcement Alarm Systems Fund.
24 (c) Moneys deposited into the Illinois Law Enforcement

1Alarm Systems Fund under this Section shall be allocated,
2subject to the approval of the Illinois Law Enforcement Alarm
3System (ILEAS) Governing Board, as follows: (i) 72% shall be
4used for homeland security initiatives established by the ILEAS
5Governing Board; (ii) 25% shall be used for airborne
6operations; and (iii) 3% shall be retained by the Illinois
7Emergency Management Agency to be used to administer the Fund.
8 (d) The Illinois Emergency Management Agency shall
9establish guidelines for the expenditure of surcharges
10collected under this Section. Under the guidelines, the
11expenditure of the surcharges shall enhance local law
12enforcement homeland security and local law enforcement mutual
13aid activities in this State and support public safety airborne
14operations. The ILEAS Governing Board shall annually supply the
15Director of the Illinois Emergency Management Agency with a
16report of the use of surcharges collected under this Section.
17 (e) This Section does not apply to vehicles owned by (i)
18units of local, State, or federal government and (ii)
19organizations based in this State that meet the requirements of
20Title 26, Section 501(c)(3) of the United States Code.".
