| 1 | AN ACT concerning regulation.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The MR/DD Community Care Act is amended by | ||||||
| 5 | changing Section 1-101.05 as follows:
| ||||||
| 6 | (210 ILCS 47/1-101.05) | ||||||

| 9 | Sec. 1-101.05. Prior law. | ||||||
| 10 | (a) This Act provides for licensure of intermediate
care | ||||||
| 11 | facilities for the developmentally disabled and long-term
care | ||||||
| 12 | for under age 22 facilities under this Act instead of under the | ||||||
| 13 | Nursing Home Care Act. On and after the effective date of this | ||||||
| 14 | Act, those facilities shall be governed by this Act instead of | ||||||
| 15 | the Nursing Home Care Act. | ||||||
| 16 | (b) If any other Act of the General Assembly changes, adds, | ||||||
| 17 | or repeals a provision of the Nursing Home Care Act that is the | ||||||
| 18 | same as or substantially similar to a provision of this Act, | ||||||
| 19 | then that change, addition, or repeal in the Nursing Home Care | ||||||
| 20 | Act shall be construed together with this Act until July 1, | ||||||
| 21 | 2010 and not thereafter. | ||||||
| 22 | (c) Nothing in this Act affects the validity or effect of | ||||||
| 23 | any finding, decision, or action made or taken by the | ||||||
| |||||||
| |||||||
| 1 | Department or the Director under the Nursing Home Care Act | ||||||
| 2 | before the effective date of this Act with respect to a | ||||||
| 3 | facility subject to licensure under this Act. That finding, | ||||||
| 4 | decision, or action shall continue to apply to the facility on | ||||||
| 5 | and after the effective date of this Act. Any finding, | ||||||
| 6 | decision, or action with respect to the facility made or taken | ||||||
| 7 | on or after the effective date of this Act shall be made or | ||||||
| 8 | taken as provided in this Act.

| 10 | Section 99. Effective date. This Act takes effect July 1, | ||||||
| 11 | 2010.
