Bill Title: Amends the Nursing Home Care Act and the Mental Health and Developmental Disabilities Code. Provides that beginning on the effective date of this amendatory Act, there shall be a 2-year moratorium on the enforcement of any new State mandate which would affect facilities or community providers unless such mandate is fully funded through a State appropriation. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Nursing Home Care Act is amended by adding | |||||||||||||||||||||
5 | Section 3-808 as follows:

6 | (210 ILCS 45/3-808 new) | |||||||||||||||||||||
7 | Sec. 3-808. Moratorium on State mandate. Beginning on the | |||||||||||||||||||||
8 | effective date of this amendatory Act of the 96th General | |||||||||||||||||||||
9 | Assembly, there shall be a 2-year moratorium on the enforcement | |||||||||||||||||||||
10 | of any new State mandate which would affect facilities or | |||||||||||||||||||||
11 | community providers unless such mandate is fully funded through | |||||||||||||||||||||
12 | a State appropriation.

13 | Section 10. The Mental Health and Developmental | |||||||||||||||||||||
14 | Disabilities Code is amended by adding Section 6-104.5 as | |||||||||||||||||||||
15 | follows:
