Bill Title: Amends the Illinois Municipal Code. Provides that municipalities may fix, charge, and collect fees not exceeding the reasonable cost of the service for all services rendered by a volunteer municipal fire department or a volunteer firefighter of any municipal fire department for persons, businesses, and other entities who are not residents of the municipality. Sets limits on the amount of fees that may be fixed, charged, and collected. Provides that the new provisions do not allow a fee to be fixed, charged, or collected that is not allowed under any contract that a fire department has entered into with another entity, including, but not limited to, fire protection districts. Effective immediately.

AN ACT concerning local government.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 5. The Illinois Municipal Code is amended by adding | ||||
Section 11-6-10 as follows:
| ||||
(65 ILCS 5/11-6-10 new) | ||||
Sec. 11-6-10. Reimbursement of volunteer fire protection | ||||
assistance. | ||||
(a) Municipalities may fix, charge, and collect fees not | ||||
exceeding the reasonable cost of the service for all services | ||||
rendered by a volunteer municipal fire department or a | ||||
volunteer firefighter of any municipal fire department for | ||||
persons, businesses, and other entities who are not residents | ||||
of the municipality. | ||||
(b) The charge for any fees under subsection (a) shall be | ||||
computed at a rate not to exceed $250 per hour and not to | ||||
exceed $70 per hour per firefighter responding to a call for | ||||
assistance. An additional charge may be levied to reimburse the | ||||
district for extraordinary expenses of materials used in | ||||
rendering such services. No charge shall be made for services | ||||
for which the total amount would be less than $50. | ||||
(c) All revenue from the fees assessed pursuant to this | ||||
Section shall be deposited to the general fund of the |
municipality. | ||
(d) Nothing in this Section shall allow a fee to be fixed, | ||
charged, or collected that is not allowed under any contract | ||
that a fire department has entered into with another entity, | ||
including, but not limited to, a fire protection district.

Section 10. The Fire Protection District Act is amended by | ||
changing Section 11f as follows:

Sec. 11f. Charge against non-residents.
| ||
(a) The board of trustees of a fire protection district may
| ||
fix, charge, and collect fees not exceeding the reasonable cost | ||
of the
service for all services rendered by the district | ||
against persons,
businesses and other entities who are not | ||
residents of the fire protection
district.
| ||
(b) Such charge may not be assessed against residents of
| ||
the fire protection district or
persons who request fire | ||
protection coverage for an unprotected area and who
pay to the | ||
fire protection district an amount equal to the district's Fire
| ||
Protection Tax pursuant to Section 4 of the Fire Protection of | ||
Unprotected
Area Act.
| ||
(c) The charge for such services shall be computed at a
| ||
rate not to exceed $250
per hour per vehicle and not to exceed | ||
$70 per hour per firefighter
responding to a call
for | ||
assistance. An additional charge may be levied to reimburse the |
district
for extraordinary expenses of materials used in | ||
rendering such services.
No charge shall be made for services | ||

Section 99. Effective date. This Act takes effect upon | ||
