1 AN ACT concerning elections.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Election Code is amended by changing
5Sections 7-10, 8-8, and 10-5 as follows:
6 (10 ILCS 5/7-10) (from Ch. 46, par. 7-10)
7 Sec. 7-10. Form of petition for nomination. The name of no
8candidate for nomination, or State central committeeperson, or
9township committeeperson, or precinct committeeperson, or ward
10committeeperson or candidate for delegate or alternate
11delegate to national nominating conventions, shall be printed
12upon the primary ballot unless a petition for nomination has
13been filed in his behalf as provided in this Article in
14substantially the following form:
15 We, the undersigned, members of and affiliated with the
16.... party and qualified primary electors of the .... party,
17in the .... of ...., in the county of .... and State of
18Illinois, do hereby petition that the following named person

2candidate or candidates, in whose behalf such petition is
3signed; the office, the political party represented and place
4of residence; and the heading of each sheet shall be the same.
5 Such petition shall be signed by qualified primary
6electors residing in the political division for which the
7nomination is sought in their own proper persons only and
8opposite the signature of each signer, his residence address
9shall be written or printed. The residence address required to
10be written or printed opposite each qualified primary
11elector's name shall include the street address or rural route
12number of the signer, as the case may be, as well as the
13signer's county, and city, village or town, and state.
14However, the county or city, village or town, and state of
15residence of the electors may be printed on the petition forms
16where all of the electors signing the petition reside in the
17same county or city, village or town, and state. Standard
18abbreviations may be used in writing the residence address,
19including street number, if any. At the bottom of each sheet of
20such petition shall be added a circulator statement signed by
21a person 18 years of age or older who is a citizen of the
22United States, stating the street address or rural route
23number, as the case may be, as well as the county, city,
24village or town, and state; and certifying that the signatures
25on that sheet of the petition were signed in his or her
26presence and certifying that the signatures are genuine; and

1either (1) indicating the dates on which that sheet was
2circulated, or (2) indicating the first and last dates on
3which the sheet was circulated, or (3) for elections where the
4petition circulation period is 90 days, certifying that none
5of the signatures on the sheet were signed more than 90 days
6preceding the last day for the filing of the petition, or (4)
7for the 2022 general primary election only, certify that the
8signatures on the sheet were signed during the period of
9January 13, 2022 through March 14, 2022 or certify that the
10signatures on the sheet were signed during the period of
11January 13, 2022 through the date on which this statement was
12sworn or affirmed to and certifying that to the best of his or
13her knowledge and belief the persons so signing were at the
14time of signing the petitions qualified voters of the
15political party for which a nomination is sought. Such
16statement shall be sworn to before some officer authorized to
17administer oaths in this State.
18 Except as otherwise provided in this Code, no petition
19sheet shall be circulated more than 90 days preceding the last
20day provided in Section 7-12 for the filing of such petition.
21 The person circulating the petition, or the candidate on
22whose behalf the petition is circulated, may strike any
23signature from the petition, provided that:
24 (1) the person striking the signature shall initial
25 the petition at the place where the signature is struck;
26 and

1 (2) the person striking the signature shall sign a
2 certification listing the page number and line number of
3 each signature struck from the petition. Such
4 certification shall be filed as a part of the petition.
5 Such sheets before being filed shall be neatly fastened
6together in book form, by placing the sheets in a pile and
7fastening them together at one edge in a secure and suitable
8manner, and the sheets shall then be numbered consecutively.
9The sheets shall not be fastened by pasting them together end
10to end, so as to form a continuous strip or roll. All petition
11sheets which are filed with the proper local election
12officials, election authorities or the State Board of
13Elections shall be the original sheets which have been signed
14by the voters and by the circulator thereof, and not
15photocopies or duplicates of such sheets. Each petition must
16include as a part thereof, a statement of candidacy for each of
17the candidates filing, or in whose behalf the petition is
18filed. This statement shall set out the address of such
19candidate, an email address for the candidate, the office for
20which he is a candidate, shall state that the candidate is a
21qualified primary voter of the party to which the petition
22relates and is qualified for the office specified (in the case
23of a candidate for State's Attorney it shall state that the
24candidate is at the time of filing such statement a licensed
25attorney-at-law of this State), shall state that he has filed
26(or will file before the close of the petition filing period) a

1statement of economic interests as required by the Illinois
2Governmental Ethics Act, shall request that the candidate's
3name be placed upon the official ballot, and shall be
4subscribed and sworn to by such candidate before some officer
5authorized to take acknowledgment of deeds in the State and
6shall be in substantially the following form:

13 The petitions, when filed, shall not be withdrawn or added
14to, and no signatures shall be revoked except by revocation
15filed in writing with the State Board of Elections, election
16authority or local election official with whom the petition is
17required to be filed, and before the filing of such petition.
18Whoever forges the name of a signer upon any petition required
19by this Article is deemed guilty of a forgery and on conviction
20thereof shall be punished accordingly.
21 A candidate for the offices listed in this Section must
22obtain the number of signatures specified in this Section on
23his or her petition for nomination.
24 (a) Statewide office or delegate to a national nominating
25convention. Except as otherwise provided in this Code, if a

1candidate seeks to run for statewide office or as a delegate or
2alternate delegate to a national nominating convention elected
3from the State at-large, then the candidate's petition for
4nomination must contain at least 5,000 but not more than
510,000 signatures.
6 (b) Congressional office or congressional delegate to a
7national nominating convention. Except as otherwise provided
8in this Code, if a candidate seeks to run for United States
9Congress or as a congressional delegate or alternate
10congressional delegate to a national nominating convention
11elected from a congressional district, then the candidate's
12petition for nomination must contain at least the number of
13signatures equal to 0.5% of the qualified primary electors of
14his or her party in his or her congressional district. In the
15first primary election following a redistricting of
16congressional districts, a candidate's petition for nomination
17must contain at least 600 signatures of qualified primary
18electors of the candidate's political party in his or her
19congressional district.
20 (c) County office. Except as otherwise provided in this
21Code, if a candidate seeks to run for any countywide office,
22including, but not limited to, county board chairperson or
23county board member, elected on an at-large basis, in a county
24other than Cook County, then the candidate's petition for
25nomination must contain at least the number of signatures
26equal to 0.5% of the qualified electors of his or her party who

1cast votes at the last preceding general election in his or her
2county. If a candidate seeks to run for county board member
3elected from a county board district, then the candidate's
4petition for nomination must contain at least the number of
5signatures equal to 0.5% of the qualified primary electors of
6his or her party in the county board district. In the first
7primary election following a redistricting of county board
8districts or the initial establishment of county board
9districts, a candidate's petition for nomination must contain
10at least the number of signatures equal to 0.5% of the
11qualified electors of his or her party in the entire county who
12cast votes at the last preceding general election divided by
13the total number of county board districts comprising the
14county board; provided that in no event shall the number of
15signatures be less than 25.
16 (d) County office; Cook County only.
17 (1) If a candidate seeks to run for countywide office
18 in Cook County, then the candidate's petition for
19 nomination must contain at least the number of signatures
20 equal to 0.5% of the qualified electors of his or her party
21 who cast votes at the last preceding general election in
22 Cook County.
23 (2) If a candidate seeks to run for Cook County Board
24 Commissioner, then the candidate's petition for nomination
25 must contain at least the number of signatures equal to
26 0.5% of the qualified primary electors of his or her party

1 in his or her county board district. In the first primary
2 election following a redistricting of Cook County Board of
3 Commissioners districts, a candidate's petition for
4 nomination must contain at least the number of signatures
5 equal to 0.5% of the qualified electors of his or her party
6 in the entire county who cast votes at the last preceding
7 general election divided by the total number of county
8 board districts comprising the county board; provided that
9 in no event shall the number of signatures be less than 25.
10 (3) Except as otherwise provided in this Code, if a
11 candidate seeks to run for Cook County Board of Review
12 Commissioner, which is elected from a district pursuant to
13 subsection (c) of Section 5-5 of the Property Tax Code,
14 then the candidate's petition for nomination must contain
15 at least the number of signatures equal to 0.5% of the
16 total number of registered voters in his or her board of
17 review district in the last general election at which a
18 commissioner was regularly scheduled to be elected from
19 that board of review district. In no event shall the
20 number of signatures required be greater than the
21 requisite number for a candidate who seeks countywide
22 office in Cook County under subsection (d)(1) of this
23 Section. In the first primary election following a
24 redistricting of Cook County Board of Review districts, a
25 candidate's petition for nomination must contain at least
26 4,000 signatures or at least the number of signatures

1 required for a countywide candidate in Cook County,
2 whichever is less, of the qualified electors of his or her
3 party in the district.
4 (e) Municipal or township office. If a candidate seeks to
5run for municipal or township office, then the candidate's
6petition for nomination must contain at least the number of
7signatures equal to 0.5% of the qualified primary electors of
8his or her party in the municipality or township. If a
9candidate seeks to run for alderperson of a municipality, then
10the candidate's petition for nomination must contain at least
11the number of signatures equal to 0.5% of the qualified
12primary electors of his or her party of the ward. In the first
13primary election following redistricting of wards or trustee
14districts of a municipality or the initial establishment of
15wards or districts, a candidate's petition for nomination must
16contain the number of signatures equal to at least 0.5% of the
17total number of votes cast for the candidate of that political
18party who received the highest number of votes in the entire
19municipality at the last regular election at which an officer
20was regularly scheduled to be elected from the entire
21municipality, divided by the number of wards or districts. In
22no event shall the number of signatures be less than 25.
23 (f) State central committeeperson. If a candidate seeks to
24run for State central committeeperson, then the candidate's
25petition for nomination must contain at least 100 signatures
26of the primary electors of his or her party of his or her

1congressional district.
2 (g) Sanitary district trustee. Except as otherwise
3provided in this Code, if a candidate seeks to run for trustee
4of a sanitary district in which trustees are not elected from
5wards, then the candidate's petition for nomination must
6contain at least the number of signatures equal to 0.5% of the
7primary electors of his or her party from the sanitary
8district. If a candidate seeks to run for trustee of a sanitary
9district in which trustees are elected from wards, then the
10candidate's petition for nomination must contain at least the
11number of signatures equal to 0.5% of the primary electors of
12his or her party in the ward of that sanitary district. In the
13first primary election following redistricting of sanitary
14districts elected from wards, a candidate's petition for
15nomination must contain at least the signatures of 150
16qualified primary electors of his or her ward of that sanitary
17district.
18 (h) Judicial office. Except as otherwise provided in this
19Code, if a candidate seeks to run for judicial office in a
20district, then the candidate's petition for nomination must
21contain the number of signatures equal to 0.4% of the number of
22votes cast in that district for the candidate for his or her
23political party for the office of Governor at the last general
24election at which a Governor was elected, but in no event less
25than 500 signatures. If a candidate seeks to run for judicial
26office in a circuit or subcircuit, then the candidate's

1petition for nomination must contain the number of signatures
2equal to 0.25% of the number of votes cast for the judicial
3candidate of his or her political party who received the
4highest number of votes at the last general election at which a
5judicial officer from the same circuit or subcircuit was
6regularly scheduled to be elected, but in no event less than
71,000 signatures in circuits and subcircuits located in the
8First Judicial District or 500 signatures in every other
9Judicial District.
10 (i) Precinct, ward, and township committeeperson. Except
11as otherwise provided in this Code, if a candidate seeks to run
12for precinct committeeperson, then the candidate's petition
13for nomination must contain at least 10 signatures of the
14primary electors of his or her party for the precinct. If a
15candidate seeks to run for ward committeeperson, then the
16candidate's petition for nomination must contain no less than
17the number of signatures equal to 10% of the primary electors
18of his or her party of the ward, but no more than 16% of those
19same electors; provided that the maximum number of signatures
20may be 50 more than the minimum number, whichever is greater.
21If a candidate seeks to run for township committeeperson, then
22the candidate's petition for nomination must contain no less
23than the number of signatures equal to 5% of the primary
24electors of his or her party of the township, but no more than
258% of those same electors; provided that the maximum number of
26signatures may be 50 more than the minimum number, whichever

1is greater.
2 (j) State's attorney or regional superintendent of schools
3for multiple counties. If a candidate seeks to run for State's
4attorney or regional Superintendent of Schools who serves more
5than one county, then the candidate's petition for nomination
6must contain at least the number of signatures equal to 0.5% of
7the primary electors of his or her party in the territory
8comprising the counties.
9 (k) Any other office. If a candidate seeks any other
10office, then the candidate's petition for nomination must
11contain at least the number of signatures equal to 0.5% of the
12registered voters of the political subdivision, district, or
13division for which the nomination is made or 25 signatures,
14whichever is greater.
15 For purposes of this Section the number of primary
16electors shall be determined by taking the total vote cast, in
17the applicable district, for the candidate for that political
18party who received the highest number of votes, statewide, at
19the last general election in the State at which electors for
20President of the United States were elected. For political
21subdivisions, the number of primary electors shall be
22determined by taking the total vote cast for the candidate for
23that political party who received the highest number of votes
24in the political subdivision at the last regular election at
25which an officer was regularly scheduled to be elected from
26that subdivision. For wards or districts of political

1subdivisions, the number of primary electors shall be
2determined by taking the total vote cast for the candidate for
3that political party who received the highest number of votes
4in the ward or district at the last regular election at which
5an officer was regularly scheduled to be elected from that
6ward or district.
7 A "qualified primary elector" of a party may not sign
8petitions for or be a candidate in the primary of more than one
9party.
10 The changes made to this Section by Public Act 93-574 are
11declarative of existing law, except for item (3) of subsection
12(d).
13 Petitions of candidates for nomination for offices herein
14specified, to be filed with the same officer, may contain the
15names of 2 or more candidates of the same political party for
16the same or different offices. In the case of the offices of
17Governor and Lieutenant Governor, a joint petition including
18one candidate for each of those offices must be filed.

22 Sec. 8-8. Form of petition for nomination. The name of no
23candidate for nomination shall be printed upon the primary
24ballot unless a petition for nomination shall have been filed
25in his behalf as provided for in this Section. Each such

2Section 7-10.1 of this Code Act and a statement of candidacy by
3the candidate filing or in whose behalf the petition is filed.

6is a candidate; , shall state that the candidate is a qualified
7primary voter of the party to which the petition relates, is
8qualified for the office specified, and has filed a statement
9of economic interests as required by the Illinois Governmental
10Ethics Act; , shall request that the candidate's name be placed
11upon the official ballot; and shall be subscribed and sworn by
12such candidate before some officer authorized to take

7 The receipt issued by the Secretary of State indicating
8that the candidate has filed the statement of economic
9interests required by the Illinois Governmental Ethics Act
10must be filed with the petitions for nomination as provided in
11subsection (8) of Section 7-12 of this Code.
12 Except as otherwise provided in this Code, all petitions
13for nomination for the office of State Senator shall be signed
14by at least 1,000 but not more than 3,000 of the qualified
15primary electors of the candidate's party in his legislative
16district.
17 Except as otherwise provided in this Code, all petitions
18for nomination for the office of Representative in the General
19Assembly shall be signed by at least 500 but not more than
201,500 of the qualified primary electors of the candidate's
21party in his or her representative district.
22 Opposite the signature of each qualified primary elector
23who signs a petition for nomination for the office of State
24Representative or State Senator such elector's residence
25address shall be written or printed. The residence address
26required to be written or printed opposite each qualified

1primary elector's name shall include the street address or
2rural route number of the signer, as the case may be, as well
3as the signer's county and city, village, or town.
4 For the purposes of this Section, the number of primary
5electors shall be determined by taking the total vote cast, in
6the applicable district, for the candidate for such political
7party who received the highest number of votes, state-wide, at
8the last general election in the State at which electors for
9President of the United States were elected.
10 A "qualified primary elector" of a party may not sign
11petitions for or be a candidate in the primary of more than one
12party.
13 In the affidavit at the bottom of each sheet, the petition
14circulator, who shall be a person 18 years of age or older who
15is a citizen of the United States, shall state his or her
16street address or rural route number, as the case may be, as
17well as his or her county, city, village or town, and state;
18and shall certify that the signatures on that sheet of the
19petition were signed in his or her presence; and shall certify
20that the signatures are genuine; and shall certify that, to
21the best of his or her knowledge and belief, the persons so
22signing were at the time of signing the petition qualified
23primary voters for which the nomination is sought.
24 In the affidavit at the bottom of each petition sheet, the
25petition circulator shall either (1) indicate the dates on
26which he or she circulated that sheet, or (2) indicate the

1first and last dates on which the sheet was circulated, or (3)
2for elections where the petition circulation period is 90
3days, certify that none of the signatures on the sheet were
4signed more than 90 days preceding the last day for the filing
5of the petition, or (4) for the 2022 general primary election
6only, certify that the signatures on the sheet were signed
7during the period of January 13, 2022 through March 14, 2022 or
8certify that the signatures on the sheet were signed during
9the period of January 13, 2022 through the date on which this
10statement was sworn or affirmed to. No petition sheet shall be
11circulated more than 90 days preceding the last day provided
12in Section 8-9 for the filing of such petition.
13 All petition sheets which are filed with the State Board
14of Elections shall be the original sheets which have been
15signed by the voters and by the circulator, and not
16photocopies or duplicates of such sheets.
17 The person circulating the petition, or the candidate on
18whose behalf the petition is circulated, may strike any
19signature from the petition, provided that:
20 (1) the person striking the signature shall initial

4 Sec. 10-5. All petitions for nomination shall, besides
5containing the names of candidates, specify as to each:
6 1. The office or offices to which such candidate or
7candidates shall be nominated.
8 2. The new political party, if any, represented, expressed
9in not more than 5 words. However, such party shall not bear
10the same name as, nor include the name of any established
11political party as defined in this Article. This prohibition
12does not preclude any established political party from making
13nominations in those cases in which it is authorized to do so.
14 3. The place of residence of any such candidate or
15candidates with the street and number thereof, if any. In the
16case of electors for President and Vice-President of the
17United States, the names of candidates for President and
18Vice-President may be added to the party name or appellation.
19 Such certificate of nomination or nomination papers in
20addition shall include as a part thereof, the oath required by
21Section 7-10.1 of this Act and must include a statement of
22candidacy for each of the candidates named therein, except
23candidates for electors for President and Vice-President of
24the United States. Each such statement shall set out the
25address of such candidate, an email address for the candidate,

4 In addition, a new political party petition shall have
5attached thereto a certificate stating the names and addresses
6of the party officers authorized to fill vacancies in
7nomination pursuant to Section 10-11.
8 Nomination papers filed under this Section are not valid
9if the candidate named therein fails to file a statement of
10economic interests as required by the Illinois Governmental
11Ethics Act in relation to his candidacy with the appropriate
12officer by the end of the period for the filing of nomination
13papers unless he has filed a statement of economic interests
14in relation to the same governmental unit with that officer
15during the same calendar year as the year in which such
16nomination papers were filed. If the nomination papers of any
17candidate and the statement of economic interest of that
18candidate are not required to be filed with the same officer,
19the candidate must file with the officer with whom the
20nomination papers are filed a receipt from the officer with
21whom the statement of economic interests is filed showing the
22date on which such statement was filed. Such receipt shall be
23so filed not later than the last day on which nomination papers
24may be filed.
