Bill Title: Amends the Public Community College Act. Amends the State Mandates Act to require implementation without reimbursement.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Public Community College Act is amended by
5 changing Section 3-42 as follows:
6 (110 ILCS 805/3-42) (from Ch. 122, par. 103-42)
7 Sec. 3-42. To employ such personnel as may be needed, to
8 establish policies governing their employment and dismissal,
9 and to fix the amount of their compensation. In the employment,
10 establishment of policies and fixing of compensation the board
11 may make no discrimination on account of sex, race, creed,
12 color or national origin.
13 Residence within any community college district or outside
14 any community college district shall not be considered:
15 (a) in determining whether to retain or not retain any
16 employee of a community college employed prior to July 1, 1977
17 or prior to the adoption by the community college board of a
18 resolution making residency within the community college
19 district of some or all employees a condition of employment,
20 whichever is later;
21 (b) in assigning, promoting or transferring any employee of
22 a community college to an office or position employed prior to
23 July 1, 1977 or prior to the adoption by the community college

1 board of a resolution making residency within the community
2 college district of some or all employees a condition of
3 employment, whichever is later; or
4 (c) in determining the salary or other compensation of any
5 employee of a community college.

7 Section 90. The State Mandates Act is amended by adding
8 Section 8.33 as follows:
9 (30 ILCS 805/8.33 new)
10 Sec. 8.33. Exempt mandate. Notwithstanding Sections 6 and 8
11 of this Act, no reimbursement by the State is required for the
12 implementation of any mandate created by this amendatory Act of
13 the 96th General Assembly.
