Bill Title: Amends the Department of State Police Law of the Civil Administrative Code of Illinois. In a Section concerning the creation and operation of a Cyber Gang Unit (instead of Internet Gang Crime Units), allocates moneys to the Lake County Metropolitan Enforcement Group (instead of to the Cook County Sheriff's Office, the City of Danville Police Department, and the Village of Round Lake Heights Police Department). Provides that the Cyber Gang Unit Pilot Program terminates on July 1, 2012 (instead of 2010). Imposes conditions on any rulemaking authority. Effective immediately.

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of State Police Law of the Civil
5 Administrative Code of Illinois is amended by changing Section
6 2605-580 as follows:
7 (20 ILCS 2605/2605-580)
8 Sec. 2605-580. Pilot program; Cyber Gang Internet Gang
9 Crime Units.
10 (a) The Department of State Police shall establish a pilot
11 program from moneys available under which Cyber Gang Internet
12 Gang Crime Units shall be created in the Lake County
13 Metropolitan Enforcement Group and the Cook County Sheriff's
14 Office, the City of Danville Police Department, and the Village
15 of Round Lake Heights Police Department. Under the pilot
16 program for the operation of Cyber Gang Internet Gang Crime
17 Units, 50% shall be allocated to the Lake County Metropolitan
18 Enforcement Group and 50% 40% shall be allocated to the Cook
19 County Sheriff's Office, 30% shall be allocated to the City of
20 Danville Police Department, and 30% shall be allocated to the
21 Village of Round Lake Heights Police Department.
22 (b) Under the pilot program, the Cyber Gang Internet Gang
23 Crime Units shall investigate criminal activities of organized

1 gangs that involve the use of the Internet. For the duration of
2 the pilot program and in accordance with protocols for
3 inter-jurisdictional cooperation established by the Department
4 of State Police, peace officers in each Cyber Gang Internet
5 Gang Crime Unit shall, notwithstanding any other provision of
6 law, have extra-jurisdictional authority to conduct
7 investigations and make arrests anywhere in the State of
8 Illinois regarding criminal activities of organized gangs that
9 involve the use of the Internet.
10 (c) Notwithstanding any other provision of law, if any
11 criminal statute of this State authorizes the distribution of
12 all or a portion of the proceeds realized from property seized
13 or forfeited under that statute to participating law
14 enforcement agencies or the delivery of property forfeited and
15 seized under that statute to participating law enforcement
16 agencies, a law enforcement agency in which a Cyber Gang an
17 Internet Gang Crime Unit has been created is eligible to
18 receive such a distribution or delivery if that law enforcement
19 agency participated through its Internet Gang Crime Unit,
20 regardless of the jurisdiction in which the seizure or
21 forfeiture occurs.
22 (d) The Lake County Metropolitan Enforcement Group and the
23 Cook County Sheriff's Office, the City of Danville Police
24 Department, and the Village of Round Lake Heights Police
25 Department shall report to the Department of State Police on a
26 quarterly basis on the activities of their Cyber Gang Internet

1 Gang Crime Units in accordance with reporting guidelines
2 established by the Department of State Police. The Department
3 of State Police shall file a consolidated report on a quarterly
4 basis with the General Assembly and the Governor. The
5 Department's consolidated report may also contain any
6 evaluations or recommendations that the Department deems
7 appropriate.
8 (e) The pilot program shall terminate on July 1, 2012 2010.
9 (f) As used in this Section, "organized gang" has the
10 meaning ascribed to it in Section 10 of the Illinois Streetgang
11 Terrorism Omnibus Prevention Act.

13 Section 99. Effective date. This Act takes effect upon
14 becoming law.
