Bill Title: Amends the Illinois Vehicle Code. Provides that the Secretary of State may grant a waiver to the requirement that religious organization bus drivers hold a valid driver's license for 3 years prior to the date of application if there was a break of 30 days or less in holding a valid driver's license during that 3 year period.

| ||||||
2 | AMENDMENT NO. ______. Amend House Bill 3685 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
5 | changing Sections 6-106.2, 6-106.3, and 6-106.4 as follows:
| ||||||
6 | (625 ILCS 5/6-106.2) (from Ch. 95 1/2, par. 6-106.2)
| ||||||
7 | Sec. 6-106.2. Religious organization bus driver. A | ||||||
8 | religious
organization bus driver shall meet the following | ||||||
9 | requirements:
| ||||||
10 | 1. is 21 years of age or older;
| ||||||
11 | 2. has a valid and properly classified driver's
license | ||||||
12 | issued by the
Secretary of State;
| ||||||
13 | 3. has held a valid driver's license, not necessarily | ||||||
14 | of the same
classification, for
3 years prior to the date
| ||||||
15 | of application . A lapse in the renewal of the driver's | ||||||
16 | license of 30 days or less shall not render the applicant |

| |||||||
1 | ineligible. The Secretary of State may, in his or her | ||||||
2 | discretion, grant a waiver for a lapse in the renewal of | ||||||
3 | the driver's license in excess of 30 days ;
| ||||||
4 | 4. has demonstrated an ability to exercise reasonable
| ||||||
5 | care in the safe
operation of religious
organization buses | ||||||
6 | in accordance with such standards as the Secretary of
State | ||||||
7 | prescribes
including a driving test in a religious | ||||||
8 | organization bus; and
| ||||||
9 | 5. has not been convicted of any of the following | ||||||
10 | offenses within 3 years of the
date of application: | ||||||
11 | Sections 11-401 (leaving the scene of a traffic
accident | ||||||
12 | involving death or personal injury), 11-501 (driving under | ||||||
13 | the
influence), 11-503 (reckless driving), 11-504 (drag | ||||||
14 | racing), and 11-506 (street racing) of this Code, or | ||||||
15 | Sections
9-3 (manslaughter or reckless homicide) and 12-5 | ||||||
16 | (reckless conduct arising
from the use of a motor vehicle) | ||||||
17 | of the Criminal Code of 1961 or the Criminal Code of 2012.

20 | Sec. 6-106.3. Senior citizen transportation - driver. A | ||||||
21 | driver of a
vehicle operated solely for the purpose of | ||||||
22 | providing transportation for
the elderly in connection with the | ||||||
23 | activities of any public or private
organization
shall meet the | ||||||
24 | following requirements:
| ||||||
25 | (1) is 21 years of age or older;

1 | (2) has a valid and properly classified driver's | ||||||
2 | license issued by the
Secretary of State;
| ||||||
3 | (3) has had a valid driver's license, not necessarily
| ||||||
4 | of the same classification, for 3 years prior to the date | ||||||
5 | of application . A lapse in the renewal of the driver's | ||||||
6 | license of 30 days or less shall not render the applicant | ||||||
7 | ineligible. The Secretary of State may, in his or her | ||||||
8 | discretion, grant a waiver for a lapse in the renewal of | ||||||
9 | the driver's license in excess of 30 days ;

10 | (4) has demonstrated his ability to exercise | ||||||
11 | reasonable care in the safe
operation of a motor vehicle | ||||||
12 | which will be utilized to transport persons
in accordance | ||||||
13 | with such standards as the Secretary of State prescribes
| ||||||
14 | including
a driving test in such motor vehicle; and
| ||||||
15 | (5) has not been convicted of any of the following | ||||||
16 | offenses within
3 years of the date of application:
| ||||||
17 | Sections 11-401 (leaving the scene of a traffic accident | ||||||
18 | involving death
or personal injury), 11-501 (driving under | ||||||
19 | the influence), 11-503 (reckless
driving), 11-504 (drag | ||||||
20 | racing), and 11-506 (street racing) of this Code, or | ||||||
21 | Sections 9-3 (manslaughter
or reckless
homicide) and 12-5 | ||||||
22 | (reckless conduct arising from the use of a motor

1 | Sec. 6-106.4. For-profit ridesharing arrangement - driver. | ||||||
2 | No person
may drive a commuter van while it is being used for a | ||||||
3 | for-profit ridesharing
arrangement unless such person:
| ||||||
4 | (1) is 21 years of age or older;
| ||||||
5 | (2) has a valid and properly classified driver's | ||||||
6 | license issued by the
Secretary of State;
| ||||||
7 | (3) has held a valid driver's license, not necessarily
| ||||||
8 | of the same classification,
for 3 years prior to the date | ||||||
9 | of application . A lapse in the renewal of the driver's | ||||||
10 | license of 30 days or less shall not render the applicant | ||||||
11 | ineligible. The Secretary of State may, in his or her | ||||||
12 | discretion, grant a waiver for a lapse in the renewal of | ||||||
13 | the driver's license in excess of 30 days ;

14 | (4) has demonstrated his ability to exercise | ||||||
15 | reasonable care in the safe
operation of commuter vans used | ||||||
16 | in for-profit ridesharing arrangements in
accordance with | ||||||
17 | such standards as the Secretary of State may prescribe,
| ||||||
18 | which standards may require a driving test in a commuter | ||||||
19 | van; and
| ||||||
20 | (5) has not been convicted of any of the following | ||||||
21 | offenses within
3 years of the date of
application: | ||||||
22 | Sections 11-401 (leaving the scene of a traffic
accident | ||||||
23 | involving death or personal injury), 11-501 (driving under
| ||||||
24 | the influence), 11-503 (reckless driving), 11-504 (drag | ||||||
25 | racing), and 11-506 (street racing) of this
Code, or
| ||||||
