2 | AMENDMENT NO. ______. Amend House Bill 3250 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Public Officer Prohibited Activities Act is | ||||||
5 | amended by adding Section 4.10 as follows:

6 | (50 ILCS 105/4.10 new) | ||||||
7 | Sec. 4.10. Limitation; more than one public office. | ||||||
8 | (a) An elected official may not hold more than one public | ||||||
9 | office simultaneously. This limitation applies regardless of | ||||||
10 | whether the elected official receives compensation for a public | ||||||
11 | office. | ||||||
12 | (b) As used in this Section: | ||||||
13 | "Elected official" means any person, other than a member of | ||||||
14 | the General Assembly, who holds an office that is subject to | ||||||
15 | election in accordance with the Election Code. | ||||||
16 | "Public office" means an office to which a person is |

1 | elected or appointed to discharge a public duty for the State | ||||||
2 | or any of its political subdivisions and an office which is | ||||||
3 | established and the qualifications and duties are prescribed by | ||||||
4 | statute. "Public office" does not include the General Assembly.

5 | Section 99. Effective date. This Act takes effect upon | ||||||
6 | becoming law.".
