1 | AN ACT concerning transportation.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Vehicle Code is amended by changing | |||||||||||||||||||
5 | Section 12-609 as follows:
| |||||||||||||||||||
6 | (625 ILCS 5/12-609) (from Ch. 95 1/2, par. 12-609)
| |||||||||||||||||||
7 | Sec. 12-609. Police vehicle equipment to be removed prior | |||||||||||||||||||
8 | to sale, transfer, or disposal. | |||||||||||||||||||
9 | (a) No official or employee of the State, any
political | |||||||||||||||||||
10 | subdivision thereof,
any county, municipality, or local | |||||||||||||||||||
11 | authority,
and no
owner or employee of any new vehicle dealer, | |||||||||||||||||||
12 | used vehicle dealer, or vehicle
auctioneer shall
sell, trade or | |||||||||||||||||||
13 | otherwise dispose of any motor
vehicle bearing equipment, | |||||||||||||||||||
14 | markings, or other indicia of police
authority unless, prior to | |||||||||||||||||||
15 | delivery of the vehicle, the equipment and
markings have been | |||||||||||||||||||
16 | sufficiently altered or obliterated to remove the
appearance of | |||||||||||||||||||
17 | such authority. Equipment, markings, and indicia that must be | |||||||||||||||||||
18 | removed according to this Section include, but are not limited | |||||||||||||||||||
19 | to, any spotlights, sirens, in-car video systems, push bumpers, | |||||||||||||||||||
20 | vehicle graphics, and any vehicle graphics or markings | |||||||||||||||||||
21 | identifying the vehicle as a police vehicle.

22 | (b) A person may not operate on the highways of this State | |||||||||||||||||||
23 | a vehicle
bearing the equipment, markings, or other indicia of |
| |||||||
| |||||||
1 | police authority, unless
the vehicle is an authorized emergency | ||||||
2 | vehicle as defined in Section 1-105 of
this Code.
| ||||||
3 | (c) This Section does not apply to vehicles bearing indicia | ||||||
4 | of police
authority that are antique vehicles, as defined in | ||||||
5 | Section 1-102.1, and are
registered as antique vehicles, as | ||||||
6 | provided in Section 3-804.
| ||||||
7 | (d) Any police officer is authorized to seize any vehicle | ||||||
8 | that is in
violation of this Section and to impound that | ||||||
9 | vehicle, at the owner's expense,
until any equipment, markings, | ||||||
10 | or other indicia of police authority have been
sufficiently | ||||||
11 | removed, altered, or obliterated to remove the appearance of
| ||||||
12 | police
authority.
| ||||||
13 | (e) A person convicted of violating this Section is guilty | ||||||
14 | of a petty
offense and subject to a fine of not less than $500 | ||||||
15 | and not more than $1,000.

17 | Section 99. Effective date. This Act takes effect upon | ||||||
18 | becoming law.
