SYNOPSIS AS INTRODUCED:
305 ILCS 5/11-7 from Ch. 23, par. 11-7

Amends the Illinois Public Aid Code. Provides that, if a recipient resides at a long-term care facility, the Department of Healthcare and Family Services shall send the notice of its decision to terminate to the recipient and the long-term care facility.

1 AN ACT concerning public aid.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5changing Section 11-7 as follows:
6 (305 ILCS 5/11-7) (from Ch. 23, par. 11-7)
7 Sec. 11-7. Notice of decisions to terminate aid -
8determination and notice of other medical assistance available -
9 additional notice in cases of blind persons.
10 Whenever decision is made to terminate aid, the recipient
11shall be notified in writing within 10 days following the
12decision. The notice shall set out the specific reasons for the
13termination. In the case of a blind person, the notice and
14statement of reasons shall be sent whenever aid is withdrawn,
15suspended, revoked, or in any way changed. In the case of a
16recipient who resides at a long-term care facility, the notice
17and statement of reasons shall be sent to the recipient and to
18the long-term care facility.
19 The notice shall include a statement defining the
20recipient's right to appeal.
21 Before any notice to terminate medical assistance is
22issued, the Illinois Department shall determine whether the
23recipient is newly eligible for any other medical assistance

1offered by the Illinois Department. For all recipients found
2eligible as a result of this determination for other medical
3assistance offered by the Illinois Department, the Illinois
4Department shall provide other medical assistance effective as
5of the date of the termination of the prior medical assistance.
