1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-335 as follows:
7 (20 ILCS 405/405-335)
8 Sec. 405-335. Illinois Transparency and Accountability
9Portal (ITAP).
10 (a) The Department, within 12 months after the effective
11date of this amendatory Act of the 96th General Assembly, shall
12establish and maintain a website, known as the Illinois
13Transparency and Accountability Portal (ITAP), with a
14full-time webmaster tasked with compiling and updating the ITAP
15database with information received from all State agencies as
16defined in this Section.
17 (b) For purposes of this Section:
18 "State agency" means (i) the offices of the constitutional
19officers identified in Article V of the Illinois Constitution,
20executive agencies, and departments, boards, commissions, and
21Authorities under the Governor and (ii) for the purposes of
22paragraph (1) of subsection (c) only, State agencies under the
23jurisdiction of the Legislative Ethics Commission.

1 "Contracts" means payment obligations with vendors on file
2with the Office of the Comptroller to purchase goods and
3services exceeding $10,000 in value (or, in the case of
4professional or artistic services, exceeding $5,000 in value).
5 "Appropriation" means line-item detail of spending
6approved by the General Assembly and Governor, categorized by
7object of expenditure.
8 "Individual consultants" means temporary workers eligible
9to receive State benefits paid on a State payroll.
10 "Recipients" means State agencies receiving
11appropriations.
12 (c) The ITAP shall provide direct access to each of the
13following:
14 (1) A database of all current and retired members of
15 the General Assembly, State employees, and individual
16 consultants, except sworn law enforcement officers, sorted
17 separately by:
18 (i) Name.
19 (ii) Employing State agency.
20 (iii) Employing State division.
21 (iv) Employment position title.
22 (v) Current pay rate and year-to-date pay,
23 including insurance benefits provided by the State.
24 (vi) Current year-to-date pension benefits
25 contributed by the State under the Illinois Pension
26 Code.

1 (2) A database of all current State expenditures,
2 sorted separately by agency, category, recipient, and
3 Representative District.
4 (3) A database of all development assistance
5 reportable pursuant to the Corporate Accountability for
6 Tax Expenditures Act, sorted separately by tax credit
7 category, taxpayer, and Representative District.
8 (4) A database of all revocations and suspensions of
9 State occupation and use tax certificates of registration
10 and all revocations and suspensions of State professional
11 licenses, sorted separately by name, geographic location,
12 and certificate of registration number or license number,
13 as applicable. Professional license revocations and
14 suspensions shall be posted only if resulting from a
15 failure to pay taxes, license fees, or child support.
16 (5) A database of all current State contracts, sorted
17 separately by contractor name, awarding officer or agency,
18 contract value, and goods or services provided.
19 (6) A database of all employees hired after the
20 effective date of this amendatory Act of 2010, sorted
21 searchably by each of the following at the time of
22 employment:
23 (i) Name.
24 (ii) Employing State agency.
25 (iii) Employing State division.
26 (iv) Employment position title.

1 (v) Current pay rate and year-to-date pay.
2 (vi) County of employment location.
3 (vii) Rutan status.
4 (viii) Status of position as subject to collective
5 bargaining, subject to merit compensation, or exempt
6 under Section 4d of the Personnel Code.
7 (ix) Employment status as probationary, trainee,
8 intern, certified, or exempt from certification.
9 (x) Status as a military veteran.
10 (d) The ITAP shall include all information required to be
11published by subsection (c) of this Section that is available
12to the Department in a format the Department can compile and
13publish on the ITAP. The Department shall update the ITAP as
14additional information becomes available in a format that can
15be compiled and published on the ITAP by the Department.
16 (e) Each State agency shall cooperate with the Department
17in furnishing the information necessary for the implementation
18of this Section within a timeframe specified by the Department.
19 (f) All information published on the ITAP as required by
20subsection (c) shall be available to the user to download in a
21CSV (comma-separated values) or spreadsheet format.
22 (g) The ITAP shall include a public forum and a commenting
23interface on which users may discuss and comment on individual
24expense items.
25 (h) The ITAP shall provide direct access to contact
26information for each State agency and each member of the

1General Assembly.

3 Section 99. Effective date. This Act takes effect January
