Bill Title: Amends the Illinois Controlled Substances Act. Provides that the Bureau of Pharmacy and Clinical Support Systems shall establish a form to allow electronic health record systems to certify the identity of a third party that will provide access to the Prescription Information Library for the electronic health record system using all or part of a computer program or system that is a federally certified Health IT Module for the electronic health record system. Provides that before the Health IT Module is permitted to connect to the Prescription Information Library, it must enter into a business associate agreement with the electronic health record system that requires the Health IT Module to agree to adhere to all requirements imposed on the electronic health record system by the laws of this State. Defines "electronic health record system".

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Life Care Facilities Act is amended by | ||||||||||||||||||||||||
5 | adding Section 13 as follows:

7 | Sec. 13. Continuing Care Retirement Community Transparency | ||||||||||||||||||||||||
8 | Task Force. | ||||||||||||||||||||||||
9 | (a) There is created a Continuing Care Retirement Community | ||||||||||||||||||||||||
10 | Transparency Task Force consisting of the following members: | ||||||||||||||||||||||||
11 | (1) The Director of Aging, or the Director's designee. | ||||||||||||||||||||||||
12 | (2) The Director of Public Health, or the Director's | ||||||||||||||||||||||||
13 | designee. | ||||||||||||||||||||||||
14 | (3) One member of the House of Representatives | ||||||||||||||||||||||||
15 | appointed by the Speaker of the House of Representatives. | ||||||||||||||||||||||||
16 | (4) One member of the House of Representatives | ||||||||||||||||||||||||
17 | appointed by the Minority Leader of the House of | ||||||||||||||||||||||||
18 | Representatives. | ||||||||||||||||||||||||
19 | (5) One member of the Senate appointed by the President | ||||||||||||||||||||||||
20 | of the Senate. | ||||||||||||||||||||||||
21 | (6) One member of the Senate appointed by the Minority | ||||||||||||||||||||||||
22 | Leader of the Senate. | ||||||||||||||||||||||||
23 | (7) One member from each of the following organizations |

1 | appointed by the Director of Public Health: | ||||||
2 | (A) 2 representatives selected from | ||||||
3 | recommendations of a statewide organization | ||||||
4 | representing retired people; | ||||||
5 | (B) 2 representatives selected from | ||||||
6 | recommendations of a statewide organization | ||||||
7 | representing Alzheimer's research; | ||||||
8 | (C) 2 representatives selected from | ||||||
9 | recommendations of a statewide organization | ||||||
10 | representing Illinois nursing home communities; | ||||||
11 | (D) One representative selected from | ||||||
12 | recommendations of a senior living facility housing 50 | ||||||
13 | residents or more; and | ||||||
14 | (E) One representative selected from | ||||||
15 | recommendations of a senior living facility housing | ||||||
16 | fewer than 50 residents. | ||||||
17 | (b) The Task Force is created to research and collect | ||||||
18 | information on transparency and consumer protection issues | ||||||
19 | related to life care contracts. The Task Force shall review | ||||||
20 | existing legal frameworks to identify all existing consumer | ||||||
21 | protections for residents living in continuing care retirement | ||||||
22 | communities and all areas in which more consumer protections | ||||||
23 | for continuing care retirement community residents are | ||||||
24 | necessary. The Task Force shall identify any shortcomings of | ||||||
25 | the definition of "life care contract" in Section 2 and | ||||||
26 | determine whether that definition should be expanded to include |

1 | more senior living facilities. | ||||||
2 | (c) The members appointed to the Task Force pursuant to | ||||||
3 | subsection (a) shall be appointed no later than 30 days after | ||||||
4 | the effective date of this amendatory Act of the 101st General | ||||||
5 | Assembly. | ||||||
6 | (d) The first meeting of the Task Force shall be no later | ||||||
7 | than 30 days after all members of the Task Force have been | ||||||
8 | appointed. The members of the Task Force shall receive no | ||||||
9 | compensation for their services but may be reimbursed for | ||||||
10 | expenses from appropriations made for that purpose. | ||||||
11 | (e) The Department of Public Health shall provide | ||||||
12 | administrative and other support to the Task Force. | ||||||
13 | (f) The Task Force shall report its findings to the | ||||||
14 | Governor and General Assembly by December 31, 2019. | ||||||
15 | (G) This Section is repealed on January 1, 2020.

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.
