Bill Title: Amends the Illinois Vehicle Code. Provides that every motor vehicle of the first division or motor vehicle of the second division weighing no more than 8,000 pounds shall at all times exhibit: (1) daytime running lights; or (2) at least 2 lighted head lamps, with at least one on each side of the front of the vehicle, showing white lights, including those emitted by high intensity discharge lamps or lights of a yellow or amber tint. Provides that a violation of the provision is a business offense punishable by a fine of $100. Defines "daytime running lights".

Amends the Illinois Vehicle Code. Provides that every motor vehicle of the first division or motor vehicle of the second division weighing no more than 8,000 pounds shall at all times exhibit: (1) daytime running lights; or (2) at least 2 lighted head lamps, with at least one on each side of the front of the vehicle, showing white lights, including those emitted by high intensity discharge lamps or lights of a yellow or amber tint. 1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by changing
5Section 12-201 as follows:
6 (625 ILCS 5/12-201) (from Ch. 95 1/2, par. 12-201)
7 Sec. 12-201. When lighted lamps are required.
8 (a) When operated upon any highway in this State, every
9motorcycle shall at all times exhibit at least one lighted
10lamp, showing a white light visible for at least 500 feet in
11the direction the motorcycle is proceeding. However, in lieu of
12such lighted lamp, a motorcycle may be equipped with and use a
13means of modulating the upper beam of the head lamp between
14high and a lower brightness. No such head lamp shall be
15modulated, except to otherwise comply with this Code, during
16times when lighted lamps are required for other motor vehicles.
17 (a-5) When operated upon any highway in this State, every
18motor vehicle of the first division or motor vehicle of the
19second division weighing no more than 8,000 pounds shall at all
20times exhibit: (1) daytime running lights; or (2) at least 2
21lighted head lamps, with at least one on each side of the front
22of the vehicle, and which satisfy United States Department of
23Transportation requirements, showing white lights, including

1those emitted by high intensity discharge (HID) lamps or lights
2of a yellow or amber tint. A violation of this subsection (a-5)
3is a business offense punishable by a fine of $100.
4 For purposes of this subsection (a-5), "daytime running
5lights" means an automotive lighting device on the front of a
6motor vehicle that is automatically switched on when the
7vehicle is moving forward and emits a white, yellow, or amber
8light.
9 (b) All other motor vehicles shall exhibit at least 2
10lighted head lamps, with at least one on each side of the front
11of the vehicle, which satisfy United States Department of
12Transportation requirements, showing white lights, including
13that emitted by high intensity discharge (HID) lamps, or lights
14of a yellow or amber tint, during the period from sunset to
15sunrise, at times when rain, snow, fog, or other atmospheric
16conditions require the use of windshield wipers, and at any
17other times when, due to insufficient light or unfavorable
18atmospheric conditions, persons and vehicles on the highway are
19not clearly discernible at a distance of 1000 feet. Parking
20lamps may be used in addition to but not in lieu of such head
21lamps. Every motor vehicle, trailer, or semi-trailer shall also
22exhibit at least 2 lighted lamps, commonly known as tail lamps,
23which shall be mounted on the left rear and right rear of the
24vehicle so as to throw a red light visible for at least 500
25feet in the reverse direction, except that a truck tractor or
26road tractor manufactured before January 1, 1968 and all

1motorcycles need be equipped with only one such tail lamp.
2 (c) Either a tail lamp or a separate lamp shall be so
3constructed and placed as to illuminate with a white light a
4rear registration plate when required and render it clearly
5legible from a distance of 50 feet to the rear. Any tail lamp
6or tail lamps, together with any separate lamp or lamps for
7illuminating a rear registration plate, shall be so wired as to
8be lighted whenever the head lamps or auxiliary driving lamps
9are lighted.
10 (d) A person shall install only head lamps that satisfy
11United States Department of Transportation regulations and
12show white light, including that emitted by HID lamps, or light
13of a yellow or amber tint for use by a motor vehicle.
