Bill Title: Amends the Election Code. Provides that a unit of local government shall make the unit's public buildings within the election authority's jurisdiction available as permanent or temporary early voting polling places without charge if the unit of local government determines that the use would neither interfere with the normal operations within the building nor cause the unit of local government to incur additional expenses, including, but not limited to, additional labor costs (currently, the use of the public building is mandatory, without exceptions, upon request of the election authority). Effective immediately.

AN ACT concerning elections.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Election Code is amended by changing
Section 19A-21 as follows:
(10 ILCS 5/19A-21)
Sec. 19A-21. Use of local public buildings for early
voting polling places. Upon request by an election authority,
a unit of local government (as defined in Section 1 of Article
VII of the Illinois Constitution, which does not include
school districts) shall make the unit's public buildings
within the election authority's jurisdiction available as
permanent or temporary early voting polling places without
charge if the unit of local government determines that the use
would neither interfere with the normal operations within the
building nor cause the unit of local government to incur
additional expenses, including, but not limited to, additional
labor costs. Availability of a building shall include
reasonably necessary time before and after the period early
voting is conducted at that building.
A unit of local government making its public building
available as a permanent or temporary early voting polling
place shall ensure that any portion of the building made

available is accessible to voters with disabilities and
elderly voters.

Section 99. Effective date. This Act takes effect upon
becoming law.
