Bill Title: Creates the Movable Soccer Goal Safety Act. Requires any organization that sets up, moves, or stores a movable soccer goal to follow all applicable guidelines for anchoring, securing, and counterweighting a movable soccer goal as those guidelines are set forth in "Guidelines for Movable Soccer Goal Safety", a publication of the U.S. Consumer Product Safety Commission. Provides that beginning on the effective date of the Act, no commercial dealer, manufacturer, importer, distributor, wholesaler, or retailer may manufacture, re-manufacture, retrofit, distribute, sell at wholesale or retail, contract to sell or resell, lease, or sublet, or otherwise place in the stream of commerce, a movable soccer goal that is not tip-resistant. Requires movable soccer goals with specified measurements to comply with applicable ASTM standards. Provides that a violation of the Act is a petty offense for which a fine not to exceed $500 may be imposed. Effective immediately.

2 | AMENDMENT NO. ______. Amend House Bill 1130 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. Short title. This Act may be cited as the | ||||||
5 | Movable Soccer Goal Safety Act or Zach's Law.
| ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "Movable soccer goal" means a freestanding structure | ||||||
8 | consisting of at least 2 upright posts, a crossbar, and support | ||||||
9 | bars that is designed: | ||||||
10 | (1) to be used by adults or children for the purposes | ||||||
11 | of a soccer goal; | ||||||
12 | (2) to be used without any other form of support or | ||||||
13 | restraint (other than pegs, stakes, augers, | ||||||
14 | counter-weights, or other types of temporary anchoring | ||||||
15 | devices); and | ||||||
16 | (3) to be able to be moved to different locations. |

1 | "Organization" means any park district, school district, | ||||||
2 | sporting club, soccer organization, unit of local government, | ||||||
3 | religious organization, business, or other similar | ||||||
4 | organization that uses, owns, or maintains a movable soccer | ||||||
5 | goal.

6 | Section 10. Installing, setting up, maintaining, or moving | ||||||
7 | a movable soccer goal. An agent or employee of an organization | ||||||
8 | shall not knowingly cause a movable soccer goal to be | ||||||
9 | unanchored or improperly anchored. Any agent or employee of an | ||||||
10 | organization that has actual notice of an unanchored or | ||||||
11 | improperly anchored movable soccer goal shall ensure that the | ||||||
12 | movable soccer goal is properly anchored or eliminate the risk | ||||||
13 | that the goal will inadvertently tip over by laying it forward | ||||||
14 | onto its face or otherwise securing it from being used in an | ||||||
15 | unanchored position.

16 | Section 15. Tip-resistant movable soccer goals required. | ||||||
17 | (a) Beginning one year after the effective date of this | ||||||
18 | Act, no commercial dealer, manufacturer, importer, | ||||||
19 | distributor, wholesaler, or retailer may manufacture, | ||||||
20 | re-manufacture, retrofit, distribute, sell at wholesale or | ||||||
21 | retail, contract to sell or resell, lease, or sublet, or | ||||||
22 | otherwise place in the stream of commerce, a movable soccer | ||||||
23 | goal that is not tip-resistant. | ||||||
24 | (b) For purposes of this Act, a movable soccer goal whose |

1 | inside measurements are 6.5 to 8 feet high and 18 to 24 feet | ||||||
2 | wide does not qualify as tip-resistant unless it conforms to | ||||||
3 | the American Society for Testing and Materials (ASTM) standard | ||||||
4 | F2673-08 for tip-resistant movable soccer goals.

5 | Section 20. Technical assistance for soccer goal safety. By | ||||||
6 | June 30, 2012, the Department of Public Health shall provide | ||||||
7 | technical assistance materials based on guidelines such as the | ||||||
8 | Guidelines for Movable Soccer Goal Safety in order to improve | ||||||
9 | soccer goal safety. The Department may make these materials | ||||||
10 | available on its website.

11 | Section 99. Effective date. This Act takes effect upon | ||||||
12 | becoming law.".
