Bill Title: Amends the Illinois Municipal Code. Provides that, if authorized by the fire chief of the fire department, any regularly enrolled volunteer fire fighter may purchase 4 vehicle tires every 3 years through his or her fire department's or municipality's joint purchasing contract relating to the purchase of vehicle tires. Further provides that the firefighter shall cover the cost of the tires and any related taxes. Limits applicability. Amends the Fire Protection District Act making similar changes. Effective immediately.

| 1 | AN ACT concerning local government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Illinois Municipal Code is amended by adding | ||||||
| 5 | Section 11-6-9 as follows:
| ||||||
| 6 | (65 ILCS 5/11-6-9 new) | ||||||
| 7 | Sec. 11-6-9. Purchase of tires under joint purchasing | ||||||
| 8 | authority. | ||||||
| 9 | (a) As used in this Section: | ||||||
| 10 | "Vehicle" has the meaning provided in Section 1-146 of the | ||||||
| 11 | Illinois Vehicle Code. | ||||||
| 12 | "Volunteer firefighter" means a firefighter who does not | ||||||
| 13 | receive monetary compensation for his or her services to a | ||||||
| 14 | municipal fire department. | ||||||
| 15 | (b) If authorized by the fire chief of the fire department, | ||||||
| 16 | any regularly enrolled volunteer firefighter may purchase 4 | ||||||
| 17 | vehicle tires every 3 years through his or her fire | ||||||
| 18 | department's or municipality's contract to purchase vehicle | ||||||
| 19 | tires under Section 2 of the Governmental Joint Purchasing Act. | ||||||
| 20 | The authorization must be in writing and on the fire | ||||||
| 21 | department's letterhead, and must include the volunteer | ||||||
| 22 | firefighter's name, the license plate number of the vehicle for | ||||||
| 23 | the authorized purchase, and must reference the fire | ||||||

| 1 | department's or municipality's joint purchasing agreement. | ||||||
| 2 | (c) The fire department or municipality shall alone be | ||||||
| 3 | responsible for documenting how many tires each volunteer | ||||||
| 4 | firefighter purchases during the specified periods under this | ||||||
| 5 | Section. | ||||||
| 6 | (d) The firefighter shall pay for any tires, and any | ||||||
| 7 | related taxes, purchased under this Section. | ||||||
| 8 | (e) Purchase of tires under this Section are not considered | ||||||
| 9 | tax exempt. | ||||||
| 10 | (f) This Section applies to contracts first solicited under | ||||||
| 11 | Section 4 of the Governmental Joint Purchasing Act on or after | ||||||
| 12 | the effective date of this amendatory Act of the 100th General | ||||||
| 13 | Assembly.
