Bill Title: Amends the Criminal Identification Act. Provides that commencing 180 days after the effective date of the amendatory Act, the Illinois State Police and all law enforcement agencies within the State shall automatically expunge, on or before January 1 and July 1 of each year, all criminal history records of an arrest, charge not initiated by arrest, order of supervision, or order of qualified probation for a misdemeanor, petty offense, or business offense, other than a violent crime defined in the Rights of Crime Victims and Witnesses Act if: (1) one year or more has elapsed since the date of the arrest or law enforcement interaction documented in the records; and (2) no criminal charges were filed relating to the arrest or law enforcement interaction or criminal charges were filed and subsequently dismissed or vacated or the arrestee was acquitted. Provides that commencing 180 days after the effective date of the amendatory Act, the clerk of the circuit court shall expunge, upon order of the court, or in the absence of a court order on or before January 1 and July 1 of each year, the court records of a person found in the circuit court to have committed a misdemeanor, petty offense, or business offense, other than a violent crime defined in the Rights of Crime Victims and Witnesses Act in the clerk's possession or control and which contains the final satisfactory disposition which pertain to the person for any of those offenses if: (1) one year or more has elapsed since the date of the arrest or law enforcement interaction documented in the records; and (2) no criminal charges were filed relating to the arrest or law enforcement interaction or criminal charges were filed and subsequently dismissed or vacated or the arrestee was acquitted. Establishes procedures for expungement of previous records.
