1 | AMENDMENT TO SENATE BILL 1055
| ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 1055 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Civil Administrative Code of Illinois is | ||||||
5 | amended by adding Section 5-647 as follows:
| ||||||
6 | (20 ILCS 5/5-647 new) | ||||||
7 | Sec. 5-647. Former department employee paid leave. | ||||||
8 | Notwithstanding any provision of law to the contrary, any | ||||||
9 | former employee of a department of State government as | ||||||
10 | provided under this Code shall, upon termination of his or her | ||||||
11 | employment with that department, be entitled to compensation | ||||||
12 | for any form of unused paid leave time owed to that person, or | ||||||
13 | any other lump sum payments otherwise owed to that person, | ||||||
14 | within 4 weeks after termination of employment with that | ||||||
15 | department. If a department fails to pay any amounts that may | ||||||
16 | be owed to a former employee under this Section within the |

1 | 4-week time period, the department shall incur an interest | ||||||
2 | penalty at the rate of 10%, or a prorated percentage thereof, | ||||||
3 | for each month the department fails to comply with this | ||||||
4 | Section, which shall be paid to the former employee in | ||||||
5 | addition to the amounts otherwise owed.

6 | Section 10. The Illinois Pension Code is amended by adding | ||||||
7 | Section 14-130.5 as follows:

8 | (40 ILCS 5/14-130.5 new) | ||||||
9 | Sec. 14-130.5. Timely determination of eligibility for and | ||||||
10 | payment of benefits. Notwithstanding any provision of law to | ||||||
11 | the contrary, after receiving a completed application for | ||||||
12 | benefits under this Article, the System shall make a | ||||||
13 | determination of eligibility for those benefits and begin | ||||||
14 | paying those benefits no later than 4 weeks after receiving | ||||||
15 | the completed application. If the System fails to pay the | ||||||
16 | benefits owed within 4 weeks after receiving the completed | ||||||
17 | application, the System shall, in addition to any other | ||||||
18 | benefit payment owed to the applicant, pay to the applicant an | ||||||
19 | amount equal to 10% of the monthly benefit owed, or a prorated | ||||||
20 | percentage thereof, for each month that the System fails to | ||||||
21 | pay the benefits owed.

22 | Section 99. Effective date. This Act takes effect upon | ||||||
23 | becoming law.".
