1 | AMENDMENT TO HOUSE BILL 1910
| ||||||
2 | AMENDMENT NO. ______. Amend House Bill 1910 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Rescue Squad Districts Act is amended by | ||||||
5 | adding Section 11.5 as follows:
| ||||||
6 | (70 ILCS 2005/11.5 new) | ||||||
7 | Sec. 11.5. Emergency medical services tax. | ||||||
8 | (a) It is declared as a matter of public policy:
| ||||||
9 | (1) that, in order to preserve, protect, and promote | ||||||
10 | the public health,
safety, and general welfare, adequate | ||||||
11 | and continuing emergency medical services should be | ||||||
12 | available to every citizen of Illinois; and
| ||||||
13 | (2) that, in the event adequate and continuing | ||||||
14 | emergency medical services do not exist, rescue squad | ||||||
15 | districts should be authorized to
provide, and shall cause | ||||||
16 | to be provided, emergency medical services as a public |
| |||||||
| |||||||
1 | responsibility. | ||||||
2 | (b) If a rescue squad district incorporated under this Act | ||||||
3 | is licensed under the Emergency Medical Services (EMS) Systems | ||||||
4 | Act, then the rescue squad district may, under the terms and | ||||||
5 | conditions set out in this Section, provide emergency medical | ||||||
6 | services, including transport within
or without the district. | ||||||
7 | The board of trustees of a rescue squad district
| ||||||
8 | incorporated under this Act may, under the terms and
conditions | ||||||
9 | set out in this Section, contract with providers of emergency | ||||||
10 | medical services that are licensed under the Emergency Medical | ||||||
11 | Services (EMS) Systems Act or enter into intergovernmental | ||||||
12 | agreements with other units of local government for the purpose | ||||||
13 | of providing emergency
medical services that are licensed under | ||||||
14 | the Emergency Medical Services (EMS) Systems Act. | ||||||
15 | The board of trustees of a rescue squad district
| ||||||
16 | incorporated under this Act may levy a tax for the provision of | ||||||
17 | emergency medical services as provided in this Section and
| ||||||
18 | adopt rules and regulations relating to emergency medical | ||||||
19 | services within its
jurisdiction.
| ||||||
20 | (c) If the board of trustees of a rescue squad district | ||||||
21 | desires
to levy a special tax to provide emergency medical | ||||||
22 | services, then it shall certify the
question to the proper | ||||||
23 | election officials, who shall submit that question
at an | ||||||
24 | election to the voters of the district. The result of the | ||||||
25 | referendum
shall be entered upon the records of the district. | ||||||
26 | If a majority of the
votes on the proposition are in favor of |

| |||||||
1 | the proposition, the board of
trustees may then levy a special | ||||||
2 | tax at a rate not to exceed 0.40% of
the value of all taxable | ||||||
3 | property within the district as equalized or
assessed by the | ||||||
4 | Department of Revenue. The proposition shall be in
| ||||||
5 | substantially the following form: | ||||||

| ||||||
8 | District levy a special tax at a rate YES
| ||||||
9 | not to exceed 0.40% of the value of all
| ||||||
10 | taxable property within the district as ---------------
| ||||||
11 | equalized or assessed by the Department
| ||||||
12 | of Revenue for the purpose of providing NO
| ||||||
13 | an emergency medical services?
| ||||||
14 | -------------------------------------------------------------
| ||||||
15 | Votes must be recorded as "Yes" or "No". | ||||||
16 | (d) If it appears that a majority of all valid votes cast | ||||||
17 | on the
proposition are in favor of levying a special tax to pay | ||||||
18 | for emergency medical services,
the board of trustees may levy | ||||||
19 | and collect an annual tax for the purpose of
providing | ||||||
20 | emergency medical services under this Act to be extended at a | ||||||
21 | rate not to
exceed 0.40% of the full fair cash value of the | ||||||
22 | taxable property within the
governmental unit as assessed or | ||||||
23 | equalized by the Department of Revenue.
This annual tax shall | ||||||
24 | be in addition to the other taxes a rescue squad
district may | ||||||
25 | levy for its corporate purposes. | ||||||
26 | (e) Any board of trustees may:

1 | (1) provide or operate an emergency medical services | ||||||
2 | subject to licensure under the Emergency Medical Services | ||||||
3 | (EMS) Systems Act;
| ||||||
4 | (2) contract with a private person, hospital, or | ||||||
5 | corporation or enter into intergovernmental agreements | ||||||
6 | with one or more units of local government for the | ||||||
7 | provision and operation of emergency medical services or | ||||||
8 | subsidize the emergency medical services; however, the | ||||||
9 | provider of the emergency medical services must be licensed | ||||||
10 | under the Emergency Medical Services (EMS) Systems Act; and
| ||||||
11 | (3) within its jurisdiction, fix, charge, and collect | ||||||
12 | fees for emergency
medical services within or outside of | ||||||
13 | the rescue squad district not
exceeding the reasonable cost | ||||||
14 | of the service.
| ||||||
15 | (f) In this Section: | ||||||
16 | "Emergency medical services" includes, without limitation, | ||||||
17 | pre-hospital care. | ||||||
18 | "Pre-hospital care" has the meaning given to that term in | ||||||
19 | Section 3.10 of the Emergency Medical Services (EMS) Systems | ||||||
20 | Act. "Pre-hospital care" includes emergency services performed | ||||||
21 | by a paramedic or other on-board emergency personnel that are | ||||||
22 | within the scope of the provider's license under the Emergency | ||||||
23 | Medical Services (EMS) Systems Act.

24 | Section 99. Effective date. This Act takes effect upon | ||||||
25 | becoming law.".
