S.F. _____ H.F. _____ DIVISION I 1 EDUCATION INFORMATION AND FUNDING 2 Section 1. Section 22.7, subsection 1, Code 2024, is amended 3 to read as follows: 4 1. Personal information in records regarding a student, 5 prospective student, or former student maintained, created, 6 collected or assembled by or for a school corporation or 7 educational institution maintaining such records. This 8 subsection shall not be construed to prohibit a postsecondary 9 education institution from disclosing to a parent or guardian 10 information regarding a violation of a federal, state, or 11 local law, or institutional rule or policy governing the use 12 or possession of alcohol or a controlled substance if the 13 child is under the age of twenty-one years and the institution 14 determines that the student committed a disciplinary violation 15 with respect to the use or possession of alcohol or a 16 controlled substance regardless of whether that information is 17 contained in the student’s education records. This subsection 18 shall not be construed to prohibit a school corporation or 19 educational institution from transferring student records 20 electronically to the department of education, an accredited 21 nonpublic school, an attendance center, a school district, or 22 an accredited postsecondary institution in accordance with 23 section 256.9, subsection 44 11 . 24 Sec. 2. Section 256.9, subsection 11, Code 2024, is amended 25 by striking the subsection and inserting in lieu thereof the 26 following: 27 11. a. Approve, coordinate, and supervise the use of 28 electronic data and information processing by school districts, 29 area education agencies, and merged areas, including the 30 procurement or development of a single, comprehensive, 31 statewide, student information system that is required to be 32 used by all school districts, accredited nonpublic schools, and 33 area education agencies. 34 b. (1) The student information system procured or developed 35 -1- LSB 5174XL (10) 90 jda/jh 1/ 8
S.F. _____ H.F. _____ shall be designed for the purpose of establishing standardized 1 electronic data collections and reporting protocols that 2 facilitate compliance with state and federal reporting 3 requirements, improve school-to-school and district-to-district 4 information exchanges, and maintain the confidentiality of 5 individual student and staff data. 6 (2) The system shall provide for the electronic transfer 7 of individual student records between attendance centers, 8 school districts, accredited nonpublic schools, area education 9 agencies, postsecondary institutions, merged areas, and the 10 department. 11 (3) The system shall be designed to ensure compatibility 12 with other information or data management systems used or 13 maintained by postsecondary institutions and merged areas as 14 required by law. 15 c. The department shall pay for the procurement or 16 development of the student information system and shall pay 17 for at least the first year of statewide implementation, after 18 which the cost of operating the system may be funded through 19 the collection of a fee by the department from each school 20 district and accredited nonpublic school. The amount of the 21 fee shall be based on a per-student rate, not to exceed twelve 22 dollars per student for the first year of the fee. 23 d. (1) Subject to subparagraph (2), the student information 24 system shall only be used for the purpose of collecting 25 information from school districts, accredited nonpublic 26 schools, and area education agencies required by state or 27 federal law or for preparation of state or federal reports. 28 (2) Notwithstanding subparagraph (1), school districts, 29 accredited nonpublic schools, and area education agencies, at 30 their own expense, may use the student information system to 31 complete other functions necessary to manage students, courses, 32 and other school district, accredited nonpublic school, and 33 area education agency functions. 34 e. A school district, accredited nonpublic school, or area 35 -2- LSB 5174XL (10) 90 jda/jh 2/ 8
S.F. _____ H.F. _____ education agency shall not duplicate the collection of any 1 information in the student information system. 2 DIVISION II 3 STUDENT ENROLLMENT 4 Sec. 3. Section 257.6, subsection 1, paragraph a, 5 unnumbered paragraph 1, Code 2024, is amended to read as 6 follows: 7 Actual enrollment is determined annually by calculating the 8 average of the sum of all of the following on October 1, or the 9 first Monday in October if October 1 falls on a Saturday or 10 Sunday, and includes all of the following and the sum of all 11 of the following on March 1 immediately succeeding the October 12 determination, or the succeeding Monday if March 1 falls on a 13 Saturday or Sunday : 14 Sec. 4. Section 257.6, subsection 3, Code 2024, is amended 15 to read as follows: 16 3. Additional enrollment because of special education. 17 a. A school district shall determine its additional 18 enrollment because of special education, as defined in this 19 section , by November October 1 of each year , or by the first 20 Monday in October if October 1 falls on a Saturday or Sunday, 21 and shall certify its additional enrollment because of special 22 education to the department of education by November October 15 23 of each year, or by the succeeding Monday if October 15 falls 24 on a Saturday or Sunday, and the department shall promptly 25 forward the information to the department of management. 26 b. For the purposes of this chapter , “additional enrollment 27 because of special education” is determined by calculating the 28 average of the following: 29 (1) An amount determined by multiplying the weighting of 30 each category of child under section 256B.9 times the number of 31 children in each category totaled for all categories minus the 32 total number of children in all categories , as determined on 33 March 1 immediately succeeding the October determination under 34 subparagraph (2), or the succeeding Monday if March 1 falls on 35 -3- LSB 5174XL (10) 90 jda/jh 3/ 8
S.F. _____ H.F. _____ a Saturday or Sunday . 1 (2) An amount determined by multiplying the weighting of 2 each category of child under section 256B.9 times the number 3 of children in each category totaled for all categories minus 4 the total number of children in all categories, as determined 5 on October 1 of each year, or the first Monday in October if 6 October 1 falls on a Saturday or Sunday. 7 Sec. 5. Section 257.6, subsection 5, paragraph a, Code 2024, 8 is amended to read as follows: 9 a. Weighted enrollment is the budget enrollment plus 10 the district’s additional enrollment because of special 11 education calculated by November 1 in October of the base year 12 under subsection 3 plus additional pupils added due to the 13 application of the supplementary weighting as determined under 14 subsection 5A . 15 Sec. 6. Section 257.6, Code 2024, is amended by adding the 16 following new subsection: 17 NEW SUBSECTION . 5A. Pupils added due to application of 18 supplementary weighting. 19 a. A school district shall determine its pupils added due 20 to application of supplementary weighting by October 1 of each 21 year, or by the first Monday in October if October 1 falls on a 22 Saturday or Sunday, and shall certify its pupils added due to 23 the application of supplementary weighting to the department 24 of education by October 15 of each year, or by the succeeding 25 Monday if October 15 falls on a Saturday or Sunday, and the 26 department shall promptly forward the information to the 27 department of management. 28 b. For the purposes of this chapter, “pupils added due 29 to application of supplementary weighting” is determined by 30 calculating the average of the following: 31 (1) The sum of the number of additional pupils assigned to 32 a student or to the school district under section 257.11 or 33 280.4, or other provision of law providing for supplementary 34 weighting, but excluding those under subsection 1, as 35 -4- LSB 5174XL (10) 90 jda/jh 4/ 8
S.F. _____ H.F. _____ determined on March 1 immediately succeeding the October 1 determination under subparagraph (2), or the succeeding Monday 2 if March 1 falls on a Saturday or Sunday. 3 (2) The sum of the number of additional pupils assigned to 4 a student or to the school district under section 257.11 or 5 280.4, or other provision of law providing for supplementary 6 weighting, but excluding those under subsection 1, as 7 determined on October 1 of each year, or the first Monday in 8 October if October 1 falls on a Saturday or Sunday. 9 Sec. 7. Section 261E.7, subsection 1, unnumbered paragraph 10 1, Code 2024, is amended to read as follows: 11 Not later than June 30 of each year, a school district 12 shall pay a tuition reimbursement amount to a postsecondary 13 institution that has enrolled its resident eligible 14 students under this chapter , unless the eligible student is 15 participating in open enrollment under section 282.18 , in 16 which case, the tuition reimbursement amount shall be paid 17 by the receiving district. However, if a child’s residency 18 changes during a school year, the tuition shall be paid by the 19 district in which the child was enrolled as of the October 20 date specified in section 257.6, subsection 1 , paragraph “a” , 21 or the district in which the child was counted under section 22 257.6, subsection 1 , paragraph “a” , subparagraph (6) , as of 23 the October date specified in section 257.6, subsection 1, 24 paragraph “a” . For students enrolled at the Iowa school for 25 the deaf, the department of education shall pay a tuition 26 reimbursement amount by June 30 of each year. The amount of 27 tuition reimbursement for each separate course shall equal the 28 lesser of: 29 Sec. 8. Section 273.5, subsection 5, Code 2024, is amended 30 to read as follows: 31 5. Provide Annually provide each school district within 32 the area served and the department of education with a special 33 education weighted enrollment count, including the additional 34 enrollment because of special education for December 1 of each 35 -5- LSB 5174XL (10) 90 jda/jh 5/ 8
S.F. _____ H.F. _____ year . 1 Sec. 9. Section 279.60, subsection 1, Code 2024, is amended 2 to read as follows: 3 1. Each school district shall administer the teaching 4 strategies gold early childhood assessment to every resident 5 prekindergarten or four-year-old child whose parent or guardian 6 enrolls the child in the district, and shall administer a valid 7 and reliable universal screening instrument, as prescribed by 8 the department of education, to every kindergarten student 9 enrolled in the district not later than the October date 10 specified in section 257.6, subsection 1 , paragraph “a” . The 11 assessment shall be aligned with state early learning standards 12 and preschool programs shall be encouraged to administer the 13 assessment at least at the beginning and end of the preschool 14 program, with the assessment information entered into the 15 statewide longitudinal data system. The department shall work 16 to develop agreements with head start programs to incorporate 17 similar information about four-year-old children served by head 18 start into the statewide longitudinal data system. 19 Sec. 10. Section 282.12, subsection 4, Code 2024, is amended 20 to read as follows: 21 4. The number of pupils participating in a whole grade 22 sharing agreement shall be determined on the October date 23 specified in section 257.6, subsection 1 , paragraph “a” , and on 24 the second Friday of January of each year. 25 Sec. 11. Section 282.18, subsection 7, paragraph a, Code 26 2024, is amended to read as follows: 27 a. If a parent or guardian of a child, who is participating 28 in open enrollment under this section , moves to a different 29 school district during the course of either district’s academic 30 year, the child’s first district of residence as determined 31 on the October date specified in section 257.6, subsection 1 , 32 paragraph “a” , shall be responsible for payment of the cost 33 per pupil plus weightings or special education costs to the 34 receiving school district for the balance of the school year in 35 -6- LSB 5174XL (10) 90 jda/jh 6/ 8
S.F. _____ H.F. _____ which the move took place. The new district of residence shall 1 be responsible for the payments during succeeding years. 2 Sec. 12. EFFECTIVE DATE. This division of this Act, being 3 deemed of immediate importance, takes effect upon enactment. 4 Sec. 13. APPLICABILITY. This division of this Act applies 5 to actual enrollment determinations for school budget years 6 beginning on or after the effective date of this division of 7 this Act. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to education, including modifying 12 provisions related to education data collection and the 13 determination of enrollment. 14 DIVISION I —— EDUCATION INFORMATION AND FUNDING. Division 15 I of the bill modifies and consolidates language regarding 16 electronic data and information duties of the director of 17 the department of education. Under the bill, the director 18 is required to approve, coordinate, and supervise the use 19 of electronic data and information processing by school 20 districts, area education agencies, and merged areas, including 21 the procurement or development of a single, comprehensive, 22 statewide, student information system that is required to be 23 used by all school districts, accredited nonpublic schools, 24 and area education agencies. The student information system 25 procured or developed must be designed for the purpose of 26 establishing standardized electronic data collections and 27 reporting protocols that facilitate compliance with state and 28 federal reporting requirements, improve school-to-school and 29 district-to-district information exchanges, and maintain the 30 confidentiality of individual student and staff data. 31 The department of education is required to pay for the 32 procurement or development of the student information system 33 and shall pay for at least the first year of statewide 34 implementation, after which the cost of operating the system 35 -7- LSB 5174XL (10) 90 jda/jh 7/ 8
S.F. _____ H.F. _____ may be funded through the collection of a fee by the department 1 from each school district and accredited nonpublic school. The 2 amount of the fee shall be based on a per-student rate, not to 3 exceed $12 per student for the first year of the fee. 4 DIVISION II —— STUDENT ENROLLMENT. Code section 257.6(1)(a) 5 provides that each school district’s actual enrollment is 6 determined annually on October 1, or the first Monday in 7 October if October 1 falls on a Saturday or Sunday. Division 8 II of the bill amends methodology for determining the actual 9 enrollment each year. Under the bill, actual enrollment is 10 determined annually by calculating the average of the count on 11 October 1, or the first Monday in October if October 1 falls 12 on a Saturday or Sunday, and the count on March 1 immediately 13 succeeding the October determination, or the succeeding Monday 14 if March 1 falls on a Saturday or Sunday. 15 Division II makes similar changes to the provisions of 16 Code section 257.6 governing the calculation of each school 17 district’s additional enrollment because of special education 18 and each school district’s pupils added due to application 19 of supplementary weighting, by requiring an average of such 20 amounts determined on two specified dates. 21 Division II makes corresponding changes to other provisions 22 of law. 23 Division II of the bill takes effect upon enactment and 24 applies to actual enrollment determinations for school budget 25 years beginning on or after the effective date of division II 26 of the bill. 27 -8- LSB 5174XL (10) 90 jda/jh 8/ 8
