Section
1.
Section
484C.2,
subsection
2,
Code
2015,
is
1
amended
to
read
as
follows:

2.
This
chapter
authorizes
the
department
of
natural
3
resources
to
regulate
preserve
whitetail
and
land
associated
4
with
a
hunting
preserve
or
a
former
hunting
preserve
.
However,
5
the
department
of
agriculture
and
land
stewardship
shall
6
regulate
whitetail
kept
as
farm
deer
pursuant
to
chapter
170
.

Sec.
2.
Section
484C.4,
Code
2015,
is
amended
to
read
as
8
follows:

484C.4
Departmental
programs
and
requirements.
10
The
department
shall
develop,
administer,
and
enforce
11
hunting
preserve
programs
and
requirements,
which
implement
the
12
provisions
of
this
chapter
and
rules
adopted
by
the
department
13
pursuant
to
section
484C.3
,
regarding
fencing,
recordkeeping,
14
reporting,
and
the
tagging,
and
transportation
,
of
preserve
15
whitetail;
testing,
and
monitoring
,
and
quarantining
for
16
disease
of
preserve
whitetail
;
and
quarantining
of
a
hunting
17
preserve
or
land
formerly
operated
as
a
hunting
preserve
where
18
diseased
preserve
whitetail
are
kept
or
were
kept
.

Sec.
3.
Section
484C.12,
Code
2015,
is
amended
by
adding
the
20
following
new
subsection:

NEW
SUBSECTION
.
3.
The
department
may
quarantine
a
hunting
22
preserve
or
land
formerly
operated
as
a
hunting
preserve
if
23
the
department
determines
that
the
presence
of
an
infectious,
24
contagious,
or
reportable
disease
on
the
hunting
preserve
25
or
former
hunting
preserve
threatens
the
health
of
animal
26
populations.
The
landowner
of
the
hunting
preserve
or
former
27
hunting
preserve
shall
comply
with
all
requirements
of
the
28
quarantine.
The
quarantine
shall
provide
for
the
maintenance
29
of
a
fence
in
the
same
manner
as
is
required
in
section
484C.6,
30
regardless
of
any
of
the
following:
31
a.
The
fence
is
not
certified
or
is
no
longer
certified
32
under
section
484C.6,
or
the
hunting
preserve
is
not
registered
33
or
is
no
longer
registered
under
section
484C.7.

b.
The
landowner
of
the
hunting
preserve
or
former
hunting

relinquished
keeping
preserve
whitetail
as
part
1
of
a
business,
including
but
not
limited
to
by
removing
any

number
of
whitetail
from
the
hunting
preserve
or
former
hunting

preserve.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

members

assembly.

This
bill
authorizes
the
department
of
natural
resources
to
8
quarantine
preserve
whitetail
and
land
associated
with
hunting
9
preserves
or
former
hunting
preserves.

The
bill
authorizes
the
department
of
natural
resources
11
to
regulate
land
associated
with
hunting
preserves
or
former
12
hunting
preserves
by
requiring
the
department
to
develop,
13
administer,
and
enforce
hunting
preserve
programs
and
14
requirements
that
include
the
quarantine
of
preserve
whitetail
15
for
disease
and
the
quarantine
of
a
hunting
preserve
or
land
16
formerly
operated
as
a
hunting
preserve
where
diseased
preserve
17
whitetail
are
kept
or
were
kept.
18
The
department
may
quarantine
a
hunting
preserve
or
former
19
hunting
preserve
if
the
department
determines
that
there
is
20
an
infectious,
contagious,
or
reportable
disease
present
on
21
that
land
that
threatens
animal
populations.
The
landowner
of
22
such
quarantined
land
must
comply
with
all
the
requirements
of
23
the
quarantine,
including
maintenance
of
fencing
in
the
same
24
manner
as
is
required
for
fencing
certification
on
hunting
25
preserves.
The
fencing
must
be
maintained
even
if
the
fence
26
has
not
been
certified
or
is
no
longer
certified,
the
hunting
27
preserve
is
not
registered
or
is
no
longer
registered,
or
the
28
landowner
has
relinquished
keeping
preserve
whitetail
as
part
29
of
a
business,
including
but
not
limited
to
by
removing
any
30
number
of
whitetail
from
the
land.
31
Pursuant
to
current
Code
section
484C.13(1),
a
violation
of
32
the
provisions
of
the
bill
or
a
rule
adopted
pursuant
to
those
33
provisions
is
punishable
as
a
simple
misdemeanor.
A
simple
34
misdemeanor
is
punishable
by
confinement
for
no
more
than
30
