SUBSTANCE ABUSE APPROPRIATION. 1 2 1. There is appropriated from the fund created by section 1 3 8.41 to the department of public health for the following 1 4 federal fiscal years beginning October 1, and ending September 1 5 30, the following amounts: 1 6 FFY 2017=2018:.................................... $ 13,093,348 1 7 FFY 2018=2019:.................................... $ 13,093,348 1 8 a. The appropriations made in this subsection are in the 1 9 amounts anticipated to be received from the federal government 1 10 for the designated federal fiscal years under 42 U.S.C., ch. 1 11 6A, subch. XVII, part B, subpart ii, which provides for the 1 12 prevention and treatment of substance abuse block grant. 1 13 The department shall expend the funds appropriated in this 1 14 subsection as provided in the federal law making the funds 1 15 available and in conformance with chapter 17A. 1 16 b. Of the funds appropriated for each federal fiscal year 1 17 in this subsection, an amount not exceeding 5 percent shall be 1 18 used by the department for administrative expenses. 1 19 c. (1) For the state fiscal year beginning July 1, 2017, 1 20 the department shall expend no less than an amount equal to 1 21 the amount expended for treatment services in the state fiscal 1 22 year beginning July 1, 2016, for pregnant women and women with 1 23 dependent children. 1 24 (2) For the state fiscal year beginning July 1, 2018, the 1 25 department shall expend no less than an amount equal to the 1 26 amount expended for treatment services in the state fiscal 1 27 year beginning July 1, 2017, for pregnant women and women with 1 28 dependent children. 1 29 2. At least 20 percent of the funds remaining from the 1 30 appropriation made in subsection 1 for each federal fiscal year 1 31 shall be allocated for prevention programs. 1 32 3. In implementing the federal prevention and treatment of 1 33 substance abuse block grant under 42 U.S.C., ch. 6A, subch. 1 34 XVII, and any other applicable provisions of the federal Public 1 35 Health Service Act under 42 U.S.C., ch. 6A, the department 2 1 shall apply the provisions of Pub. L. No. 106=310, {3305, 2 2 as codified in 42 U.S.C. {300x=65, relating to services 2 3 under such federal law being provided by religious and other 2 4 nongovernmental organizations. 2 5 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 2 6 1. a. There is appropriated from the fund created by 2 7 section 8.41 to the department of human services for the 2 8 following federal fiscal years beginning October 1, and ending 2 9 September 30, the following amounts: 2 10 FFY 2017=2018:.................................... $ 4,067,863 2 11 FFY 2018=2019:.................................... $ 4,067,863 2 12 b. The appropriations made in this subsection are in the 2 13 amounts anticipated to be received from the federal government 2 14 for the designated federal fiscal years under 42 U.S.C., ch. 2 15 6A, subch. XVII, part B, subpart i, which provides for the 2 16 community mental health services block grant. The department 2 17 shall expend the funds appropriated in this subsection as 2 18 provided in the federal law making the funds available and in 2 19 conformance with chapter 17A. 2 20 c. The department shall allocate not less than 95 percent 2 21 of the amount of the block grant each federal fiscal year for 2 22 eligible community mental health services for carrying out the 2 23 plan submitted to and approved by the federal substance abuse 2 24 and mental health services administration for the fiscal year 2 25 involved. 2 26 d. Of the amount allocated to eligible services providers 2 27 in paragraph "c", 70 percent of the amount each federal fiscal 2 28 year shall be distributed to the state's accredited community 2 29 mental health centers established in accordance with chapter 2 30 230A or applicable administrative rule. If a mental health 2 31 services provider was designated as authorized in section 2 32 230A.107, subsection 2, the provider remains eligible to 2 33 receive funding distributed pursuant to this paragraph as 2 34 a community mental health center. The funding distributed 2 35 shall be used by recipients of the funding for the purpose of 3 1 staff training or services to adults with a serious mental 3 2 illness and children with a serious emotional disturbance. 3 3 The distribution amounts shall be announced at the beginning 3 4 of the federal fiscal year and distributed on a quarterly 3 5 basis. Recipients shall submit quarterly reports containing 3 6 data consistent with the performance measures approved 3 7 by the federal substance abuse and mental health services 3 8 administration. 3 9 2. An amount not exceeding 5 percent of the funds 3 10 appropriated in subsection 1 for each federal fiscal year shall 3 11 be used by the department of human services for administrative 3 12 expenses. From the funds set aside by this subsection for 3 13 administrative expenses, the department shall pay to the 3 14 auditor of state an amount sufficient to pay the cost of 3 15 auditing the use and administration of the state's portion of 3 16 the funds appropriated in subsection 1. The auditor of state 3 17 shall bill the department for the costs of the audits. 3 18 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 3 19 1. There is appropriated from the fund created by section 3 20 8.41 to the department of public health for the following 3 21 federal fiscal years beginning October 1, and ending September 3 22 30, the following amounts: 3 23 FFY 2017=2018:.................................... $ 6,495,727 3 24 FFY 2018=2019:.................................... $ 6,495,727 3 25 a. The appropriations made in this subsection are in the 3 26 amounts anticipated to be received from the federal government 3 27 for the designated federal fiscal years under 42 U.S.C., ch. 3 28 7, subch. V, which provides for the maternal and child health 3 29 services block grant. The department shall expend the funds 3 30 appropriated in this subsection as provided in the federal law 3 31 making the funds available and in conformance with chapter 17A. 3 32 b. Funds appropriated in this subsection shall not be used 3 33 by the university of Iowa hospitals and clinics for indirect 3 34 costs. 3 35 2. An amount not exceeding 10 percent of the funds 4 1 appropriated in subsection 1 for each federal fiscal year shall 4 2 be used by the department of public health for administrative 4 3 expenses. 4 4 3. The departments of public health, human services, and 4 5 education and the university of Iowa's mobile and regional 4 6 child health specialty clinics shall continue to pursue to the 4 7 maximum extent feasible the coordination and integration of 4 8 services to women and children. 4 9 4. a. Sixty=three percent of the amount remaining after 4 10 the allocation made in subsection 2 for each federal fiscal 4 11 year shall be allocated to supplement appropriations for 4 12 maternal and child health programs within the department of 4 13 public health. Of these funds, the following amounts shall 4 14 be set aside for the statewide perinatal care program for the 4 15 following federal fiscal years: 4 16 FFY 2017=2018:.................................... $ 300,291 4 17 FFY 2018=2019:.................................... $ 300,291 4 18 b. Thirty=seven percent of the amount remaining after 4 19 the allocation made in subsection 2 for each federal fiscal 4 20 year shall be allocated to the university of Iowa hospitals 4 21 and clinics under the control of the state board of regents 4 22 for mobile and regional child health specialty clinics. The 4 23 university of Iowa hospitals and clinics shall not receive an 4 24 allocation for indirect costs from the funds for this program. 4 25 Priority shall be given to establishment and maintenance of a 4 26 statewide system of mobile and regional child health specialty 4 27 clinics. 4 28 5. The department of public health shall administer the 4 29 statewide maternal and child health program and the disabled 4 30 children's program by conducting mobile and regional child 4 31 health specialty clinics and conducting other activities to 4 32 improve the health of low=income women and children and to 4 33 promote the welfare of children with actual or potential 4 34 handicapping conditions and chronic illnesses in accordance 4 35 with the requirements of Tit. V of the federal Social Security 5 1 Act. 5 2 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES 5 3 APPROPRIATIONS. 5 4 1. There is appropriated from the fund created by section 5 5 8.41 to the department of public health for the following 5 6 federal fiscal years beginning October 1, and ending September 5 7 30, the following amounts: 5 8 FFY 2017=2018:.................................... $ 1,702,233 5 9 FFY 2018=2019:.................................... $ 1,702,233 5 10 The appropriations made in this subsection are in the 5 11 amounts anticipated to be received from the federal government 5 12 for the designated federal fiscal years under 42 U.S.C., ch. 5 13 6A, subch. XVII, part A, which provides for the preventive 5 14 health and health services block grant. The department shall 5 15 expend the funds appropriated in this subsection as provided in 5 16 the federal law making the funds available and in conformance 5 17 with chapter 17A. 5 18 2. Of the funds appropriated in subsection 1 for each 5 19 federal fiscal year, an amount not exceeding 10 percent shall 5 20 be used by the department for administrative expenses. 5 21 3. Of the funds appropriated in subsection 1 for each 5 22 federal fiscal year, the specific amount of funds stipulated 5 23 by the notice of the block grant award shall be allocated for 5 24 services to victims of sex offenses and for rape prevention 5 25 education. 5 26 4. After deducting the funds allocated in subsections 2 and 5 27 3, the remaining funds appropriated in subsection 1 for each 5 28 federal fiscal year may be used by the department for healthy 5 29 people 2020 and Iowa's health improvement plan 2012=2016 5 30 program objectives, preventive health advisory committee, and 5 31 risk reduction services, including nutrition programs, health 5 32 incentive programs, chronic disease services, emergency medical 5 33 services, monitoring of the fluoridation program and start=up 5 34 fluoridation grants, and acquired immune deficiency syndrome 5 35 services. The moneys specified in this subsection shall not be 6 1 used by the university of Iowa hospitals and clinics or by the 6 2 state hygienic laboratory for the funding of indirect costs. 6 3 Sec. 5. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 6 4 APPROPRIATION. 6 5 1. There is appropriated from the fund created by section 6 6 8.41 to the department of justice for the following federal 6 7 fiscal years beginning October 1, and ending September 30, the 6 8 following amounts: 6 9 FFY 2017=2018:.................................... $ 1,760,043 6 10 FFY 2018=2019:.................................... $ 1,760,043 6 11 The appropriations made in this subsection are in the 6 12 amounts anticipated to be received from the federal government 6 13 for the designated fiscal years under 42 U.S.C., ch. 46, 6 14 subch. XII=H which provides for grants to combat violent 6 15 crimes against women. The department of justice shall expend 6 16 the funds appropriated in this subsection as provided in the 6 17 federal law making the funds available and in conformance with 6 18 chapter 17A. 6 19 2. An amount not exceeding 10 percent of the funds 6 20 appropriated in subsection 1 shall be used by the department of 6 21 justice for administrative expenses. From the funds set aside 6 22 by this subsection for administrative expenses, the department 6 23 shall pay to the auditor of state an amount sufficient to pay 6 24 the cost of auditing the use and administration of the state's 6 25 portion of the funds appropriated in subsection 1. 6 26 Sec. 6. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 6 27 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from 6 28 the fund created by section 8.41 to the governor's office of 6 29 drug control policy for the following federal fiscal years 6 30 beginning October 1, and ending September 30, the following 6 31 amounts: 6 32 FFY 2017=2018:.................................... $ 94,916 6 33 FFY 2018=2019:.................................... $ 94,916 6 34 The appropriations made in this section are the amounts 6 35 anticipated to be received from the federal government for the 7 1 designated federal fiscal years under 42 U.S.C., ch. 46, subch. 7 2 XII=G, which provides grants for substance abuse treatment 7 3 programs in state and local correctional facilities. The drug 7 4 policy coordinator shall expend the funds appropriated in this 7 5 section as provided in federal law making the funds available 7 6 and in conformance with chapter 17A. 7 7 Sec. 7. EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT 7 8 PROGRAM APPROPRIATION. There is appropriated from the fund 7 9 created by section 8.41 to the governor's office of drug 7 10 control policy for the following federal fiscal years beginning 7 11 October 1, and ending September 30, the following amounts: 7 12 FFY 2017=2018:.................................... $ 1,823,729 7 13 FFY 2018=2019:.................................... $ 1,823,729 7 14 The appropriations made in this section are in the amounts 7 15 anticipated to be received from the federal government for the 7 16 designated fiscal years under 42 U.S.C., ch. 46, subch. V, 7 17 which provides for the Edward Byrne memorial justice assistance 7 18 grant program. The drug policy coordinator shall expend the 7 19 funds appropriated in this section as provided in the federal 7 20 law making the funds available and in conformance with chapter 7 21 17A. 7 22 Sec. 8. COMMUNITY SERVICES APPROPRIATIONS. 7 23 1. a. There is appropriated from the fund created by 7 24 section 8.41 to the division of community action agencies 7 25 of the department of human rights for the following federal 7 26 fiscal years beginning October 1, and ending September 30, the 7 27 following amounts: 7 28 FFY 2017=2018:.................................... $ 7,702,858 7 29 FFY 2018=2019:.................................... $ 7,702,858 7 30 The appropriations made in this subsection are in the 7 31 amounts anticipated to be received from the federal government 7 32 for the designated federal fiscal years under 42 U.S.C., ch. 7 33 106, which provides for the community services block grant. 7 34 The division of community action agencies of the department 7 35 of human rights shall expend the funds appropriated in this 8 1 subsection as provided in the federal law making the funds 8 2 available and in conformance with chapter 17A. 8 3 b. Each federal fiscal year, the administrator of the 8 4 division of community action agencies of the department 8 5 of human rights shall allocate not less than 96 percent of 8 6 the amount of the block grants to eligible community action 8 7 agencies for programs benefiting low=income persons. Each 8 8 eligible agency shall receive a minimum allocation of not 8 9 less than $100,000. The minimum allocation shall be achieved 8 10 by redistributing increased funds from agencies experiencing 8 11 a greater share of available funds. The funds shall be 8 12 distributed on the basis of the poverty=level population in the 8 13 area represented by the community action areas compared to the 8 14 size of the poverty=level population in the state. 8 15 2. An amount not exceeding 4 percent of the funds 8 16 appropriated in subsection 1 for each federal fiscal year shall 8 17 be used by the division of community action agencies of the 8 18 department of human rights for administrative expenses. From 8 19 the funds set aside by this subsection for administrative 8 20 expenses, the division of community action agencies of the 8 21 department of human rights shall pay to the auditor of state 8 22 an amount sufficient to pay the cost of auditing the use and 8 23 administration of the state's portion of the funds appropriated 8 24 in subsection 1. The auditor of state shall bill the division 8 25 of community action agencies for the costs of the audits. 8 26 Sec. 9. COMMUNITY DEVELOPMENT APPROPRIATIONS. 8 27 1. There is appropriated from the fund created by section 8 28 8.41 to the economic development authority for the following 8 29 federal fiscal years beginning October 1, and ending September 8 30 30, the following amounts: 8 31 FFY 2017=2018:.................................... $ 22,500,000 8 32 FFY 2018=2019:.................................... $ 22,500,000 8 33 The appropriations made in this subsection are in the 8 34 amounts anticipated to be received from the federal government 8 35 for the designated federal fiscal years under 42 U.S.C., ch. 9 1 69, which provides for community development block grants. 9 2 The economic development authority shall expend the funds 9 3 appropriated in this subsection as provided in the federal law 9 4 making the funds available and in conformance with chapter 17A. 9 5 2. a. An amount not exceeding $1,000,000 for the federal 9 6 fiscal year beginning October 1, 2017, shall be used by the 9 7 economic development authority for administrative expenses for 9 8 the community development block grant. The total amount used 9 9 for administrative expenses includes $550,000 for the federal 9 10 fiscal year beginning October 1, 2017, of funds appropriated 9 11 in subsection 1 and a matching contribution from the state 9 12 equal to $450,000 from the appropriation of state funds for 9 13 the community development block grant and state appropriations 9 14 for related activities of the economic development authority. 9 15 From the funds set aside for administrative expenses by this 9 16 subsection, the economic development authority shall pay to 9 17 the auditor of state an amount sufficient to pay the cost of 9 18 auditing the use and administration of the state's portion of 9 19 the funds appropriated in subsection 1. The auditor of state 9 20 shall bill the authority for the costs of the audit. 9 21 b. An amount not exceeding $1,000,000 for the federal 9 22 fiscal year beginning October 1, 2018, shall be used by the 9 23 economic development authority for administrative expenses for 9 24 the community development block grant. The total amount used 9 25 for administrative expenses includes $550,000 for the federal 9 26 fiscal year beginning October 1, 2018, of funds appropriated 9 27 in subsection 1 and a matching contribution from the state 9 28 equal to $450,000 from the appropriation of state funds for 9 29 the community development block grant and state appropriations 9 30 for related activities of the economic development authority. 9 31 From the funds set aside for administrative expenses by this 9 32 subsection, the economic development authority shall pay to 9 33 the auditor of state an amount sufficient to pay the cost of 9 34 auditing the use and administration of the state's portion of 9 35 the funds appropriated in subsection 1. The auditor of state 10 1 shall bill the authority for the costs of the audit. 10 2 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATION ==== DISASTER 10 3 RELIEF. 10 4 1. There is appropriated from the fund created by section 10 5 8.41 to the economic development authority for the federal 10 6 fiscal year beginning October 1, 2017, and ending September 30, 10 7 2018, the following amount: 10 8 .................................................. $ 96,887,177 10 9 The appropriation made in this subsection is in the amount 10 10 anticipated to be received from the federal government for 10 11 the designated federal fiscal year under Pub. L. No. 113=2, 10 12 Disaster Relief Appropriations Act of 2013. 10 13 2. The economic development authority shall expend the 10 14 funds appropriated in this section to make Iowa communities 10 15 more resilient to flooding and improve Iowa's water quality as 10 16 provided in the federal law making the funds available and in 10 17 conformance with chapter 17A. 10 18 3. An amount not exceeding 3 percent of the funds 10 19 appropriated in subsection 1 shall be used by the authority 10 20 for administrative expenses. From the funds set aside by this 10 21 subsection for administrative expenses, the authority shall pay 10 22 to the auditor of state an amount sufficient to pay the cost of 10 23 auditing the use and administration of the state's portion of 10 24 the funds appropriated in subsection 1. 10 25 Sec. 11. SURFACE TRANSPORTATION BLOCK GRANT PROGRAM 10 26 APPROPRIATION. There is appropriated from the fund created 10 27 by section 8.41 to the department of transportation for the 10 28 following federal fiscal years beginning October 1, and ending 10 29 September 30, the following amounts: 10 30 FFY 2017=2018:.................................... $152,500,000 10 31 FFY 2018=2019:.................................... $155,200,000 10 32 The appropriations made in this section are the amounts 10 33 anticipated to be received from the federal government for the 10 34 designated fiscal years under 23 U.S.C., ch. 23, sec. 133, 10 35 which provides funding allocated by the state transportation 11 1 commission for state and local transportation projects. The 11 2 department shall expend the moneys appropriated in this section 11 3 as provided in the federal law making the funds available and 11 4 in conformance with chapter 17A. 11 5 Sec. 12. LOW=INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 11 6 1. There is appropriated from the fund created by section 11 7 8.41 to the division of community action agencies of the 11 8 department of human rights for the following federal fiscal 11 9 years beginning October 1, and ending September 30, the 11 10 following amounts: 11 11 FFY 2017=2018:.................................... $ 52,905,010 11 12 FFY 2018=2019:.................................... $ 52,905,010 11 13 The appropriations made in this subsection are in the 11 14 amounts anticipated to be received from the federal government 11 15 for the designated federal fiscal years under 42 U.S.C., ch. 11 16 94, subch. II, which provides for the low=income home energy 11 17 assistance block grants. The division of community action 11 18 agencies of the department of human rights shall expend the 11 19 funds appropriated in this subsection as provided in the 11 20 federal law making the funds available and in conformance with 11 21 chapter 17A. 11 22 2. Up to 15 percent, or up to 25 percent if a waiver is 11 23 approved by the United States department of health and human 11 24 services, of the amount appropriated in this section that is 11 25 actually received for each federal fiscal year shall be used 11 26 for residential weatherization or other related home repairs 11 27 for low=income households. Of this allocation amount, not more 11 28 than 10 percent may be used for administrative expenses. 11 29 3. After subtracting the allocation in subsection 2, up to 11 30 10 percent of the remaining moneys for each federal fiscal year 11 31 are allocated for administrative expenses of the low=income 11 32 home energy assistance program of which $377,000 is allocated 11 33 each federal fiscal year for administrative expenses of the 11 34 division. The costs of auditing the use and administration 11 35 of the portion of the appropriation in this section that is 12 1 retained by the state shall be paid from the amount allocated 12 2 in this subsection each federal fiscal year to the division. 12 3 The auditor of state shall bill the division for the audit 12 4 costs. 12 5 4. The remaining moneys of the appropriation made in this 12 6 section for each federal fiscal year following the allocations 12 7 made in subsections 2 and 3, shall be used to help eligible 12 8 households as defined in 42 U.S.C., ch. 94, subch. II, to meet 12 9 home energy costs. 12 10 5. Not more than 10 percent of the amount appropriated in 12 11 this section each federal fiscal year that is actually received 12 12 may be carried forward for use in the succeeding federal fiscal 12 13 year. 12 14 6. Expenditures for assessment and resolution of energy 12 15 problems shall be limited to not more than 5 percent of the 12 16 amount appropriated in this section for each federal fiscal 12 17 year that is actually received. 12 18 Sec. 13. SOCIAL SERVICES APPROPRIATIONS. 12 19 1. There is appropriated from the fund created by section 12 20 8.41 to the department of human services for the following 12 21 federal fiscal years beginning October 1, and ending September 12 22 30, the following amounts: 12 23 FFY 2017=2018:.................................... $ 15,270,606 12 24 FFY 2018=2019:.................................... $ 15,270,606 12 25 The appropriations made in this subsection are in the 12 26 amounts anticipated to be received from the federal government 12 27 for the designated federal fiscal years under 42 U.S.C., ch. 12 28 7, subch. XX, which provides for the social services block 12 29 grant. The department of human services shall expend the funds 12 30 appropriated in this subsection as provided in the federal law 12 31 making the funds available and in conformance with chapter 17A. 12 32 2. Not more than the following amounts of the funds 12 33 appropriated in subsection 1 for the following federal fiscal 12 34 years shall be used by the department of human services for 12 35 general administration: 13 1 a. FFY 2018=2019: 13 4 .................................................. $ 910,649 13 5 From the funds set aside in this subsection for general 13 6 administration for each federal fiscal year, the department 13 7 of human services shall pay to the auditor of state an 13 8 amount sufficient to pay the cost of auditing the use and 13 9 administration of the state's portion of the funds appropriated 13 10 in subsection 1. 13 11 3. SOCIAL SERVICES BLOCK GRANT PLAN. The department 14 18 of human services during each state fiscal year shall develop a 14 19 plan for the use of federal social services block grant funds 14 20 for the subsequent state fiscal year. 14 21 The proposed plan shall include all programs and services 14 22 at the state level which the department proposes to fund with 14 23 federal social services block grant funds, and shall identify 14 24 state and other funds which the department proposes to use to 14 25 fund the state programs and services. 14 26 The proposed plan shall also include all local programs and 14 27 services which are eligible to be funded with federal social 14 28 services block grant funds, the total amount of federal social 14 29 services block grant funds available for the local programs and 14 30 services, and the manner of distribution of the federal social 14 31 services block grant funds to the counties. The proposed plan 14 32 shall identify state and local funds which will be used to fund 14 33 the local programs and services. 14 34 The proposed plan shall be submitted with the department's 14 35 budget requests to the governor and the general assembly. 15 1 Sec. 15. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 15 2 HOMELESSNESS. 15 3 1. Upon receipt of the minimum formula grant from 15 4 the federal substance abuse and mental health services 15 5 administration to provide mental health services for the 15 6 homeless, for the federal fiscal years beginning October 1, 15 7 2017, and October 1, 2018, the department of human services 15 8 shall assure that a project which receives funds under the 15 9 formula grant shall do all of the following: 15 10 a. Provide outreach and engagement to homeless individuals 15 11 and individuals at risk of homelessness and assesses those 15 12 individuals for serious mental illness. 15 13 b. Enroll those individuals with serious mental illness who 15 14 are willing to accept services through the project. 15 15 c. Provide case management to homeless persons. 15 16 d. Provide appropriate training to persons who provide 15 17 services to persons targeted by the grant. 15 18 e. Assure a local match share of 25 percent. 15 19 f. Refer homeless individuals and individuals at risk of 15 20 homelessness to primary health care, job training, educational 15 21 services, and relevant housing services. 15 22 2. A project may expend funds for community mental health 15 23 services, diagnostic services, crisis intervention services, 15 24 habilitation and rehabilitation services, substance=related 15 25 disorder services, supportive and supervisory services to 15 26 homeless persons living in residential settings that are 15 27 not otherwise supported, and housing services including 15 28 minor renovation, expansion, and repair of housing, security 15 29 deposits, planning of housing, technical assistance in 15 30 applying for housing, improving the coordination of housing 15 31 services, the costs associated with matching eligible homeless 15 32 individuals with appropriate housing, and one=time rental 15 33 payments to prevent eviction. 15 34 Sec. 16. CHILD CARE AND DEVELOPMENT APPROPRIATION. There 15 35 is appropriated from the fund created by section 8.41 to 16 1 the department of human services for the following federal 16 2 fiscal years beginning October 1, and ending September 30, the 16 3 following amounts: 16 4 FFY 2017=2018:.................................... $ 49,505,620 16 5 FFY 2018=2019:.................................... $ 49,891,277 16 6 The appropriations made in this section are in the amounts 16 7 anticipated to be received from the federal government for 16 8 the designated federal fiscal years under 42 U.S.C., ch. 16 9 105, subch. II=B, which provides for the child care and 16 10 development block grant. The department shall expend the funds 16 11 appropriated in this section as provided in the federal law 16 12 making the funds available and in conformance with chapter 17A. 16 13 Moneys appropriated in this section that remain unencumbered 16 14 or unobligated at the close of the fiscal year shall revert to 16 15 be available for appropriation for purposes of the child care 16 16 and development block grant in the succeeding fiscal year. 16 17 Sec. 17. PROCEDURE FOR REDUCED FEDERAL FUNDS. 16 18 1. If the funds received from the federal government for the 16 19 block grants specified in this Act are less than the amounts 16 20 appropriated, the funds actually received shall be prorated 16 21 by the governor for the various programs, other than for the 16 22 services to victims of sex offenses and for rape prevention 16 23 education under section 4, subsection 3, of this Act, for which 16 24 each block grant is available according to the percentages that 16 25 each program is to receive as specified in this Act. However, 16 26 if the governor determines that the funds allocated by the 16 27 percentages will not be sufficient to accomplish the purposes 16 28 of a particular program, or if the appropriation is not 16 29 allocated by percentage, the governor may allocate the funds in 16 30 a manner which will accomplish to the greatest extent possible 16 31 the purposes of the various programs for which the block grants 16 32 are available. 16 33 2. Before the governor implements the actions provided for 16 34 in subsection 1, the following procedures shall be taken: 16 35 a. The chairpersons and ranking members of the senate and 17 1 house standing committees on appropriations, the appropriate 17 2 chairpersons and ranking members of subcommittees of those 17 3 committees, and the director of the legislative services agency 17 4 shall be notified of the proposed action. 17 5 b. The notice shall include the proposed allocations, 17 6 and information on the reasons why particular percentages or 17 7 amounts of funds are allocated to the individual programs, 17 8 the departments and programs affected, and other information 17 9 deemed useful. Chairpersons and ranking members notified shall 17 10 be allowed at least two weeks to review and comment on the 17 11 proposed action before the action is taken. 17 12 Sec. 18. PROCEDURE FOR INCREASED FEDERAL FUNDS. 17 13 1. If funds received from the federal government in the form 17 14 of block grants exceed the amounts appropriated in sections 1, 17 15 2, 3, 4, 7, 9, and 13 of this Act, the excess shall be prorated 17 16 to the appropriate programs according to the percentages 17 17 specified in those sections, except additional funds shall not 17 18 be prorated for administrative expenses. 17 19 2. If actual funds received from the federal government 17 20 from block grants exceed the amount appropriated in section 12 17 21 of this Act for the low=income home energy assistance program, 17 22 not more than 15 percent of the excess may be allocated to the 17 23 low=income residential weatherization program and not more than 17 24 10 percent of the excess may be used for administrative costs. 17 25 3. If funds received from the federal government from 17 26 community services block grants exceed the amount appropriated 17 27 in section 8 of this Act, 100 percent of the excess is 17 28 allocated to the community services block grant program. 17 29 Sec. 19. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 17 30 FUNDS. If other federal grants, receipts, and funds and other 17 31 nonstate grants, receipts, and funds become available or are 17 32 awarded which are not available or awarded during the period 17 33 in which the general assembly is in session, but which require 17 34 expenditure by the applicable department or agency prior to 17 35 March 15 of the fiscal years beginning July 1, 2017, and July 18 1 1, 2018, these grants, receipts, and funds are appropriated to 18 2 the extent necessary, provided that the fiscal committee of 18 3 the legislative council is notified within 30 days of receipt 18 4 of the grants, receipts, or funds and the fiscal committee of 18 5 the legislative council has an opportunity to comment on the 18 6 expenditure of the grants, receipts, or funds. 18 7 Sec. 20. OTHER GRANTS, RECEIPTS, AND FUNDS. Federal grants, 18 8 receipts, and funds and other nonstate grants, receipts, and 18 9 funds, available in whole or in part of the state fiscal years 18 10 beginning July 1, 2017, and July 1, 2018, are appropriated to 18 11 the following departments and agencies that are designated 18 12 by and for the purposes set forth in the grants, receipts, 18 13 or conditions accompanying the receipt of the funds, unless 18 14 otherwise provided by law: 18 15 1. The section of this Act 19 20 making an appropriation to the economic development authority 19 21 in the amount anticipated to be received from the federal 19 22 government under Pub. L. No. 113=2, being deemed of immediate 19 23 importance, takes effect upon enactment. 19 24 Sec. 22. RETROACTIVE APPLICABILITY. The section of this Act 19 25 making an appropriation to the economic development authority 19 26 in the amount anticipated to be received from the federal 19 27 government under Pub. L. No. 113=2 applies retroactively to 19 28 October 1, 2014. 19 29 EXPLANATION 19 30 The inclusion of this explanation does not constitute agreement with 19 31 the explanation's substance by the members of the general assembly. 19 32 This bill makes appropriations of federal block grants, 19 33 other federal funds, and nonstate funds. 19 34 The bill appropriates for the 2017=2018 federal fiscal year 19 35 and the 2018=2019 federal fiscal year block grants available 20 1 from the federal government and provides procedures for 20 2 increasing or decreasing the appropriations if the amounts 20 3 block grants are increased or decreased from the amounts 20 4 anticipated. The federal fiscal year begins on October 1, and 20 5 the state fiscal year begins July 1. 20 6 The bill also makes standing appropriations for the 20 7 2017=2018 state fiscal year and the 2018=2019 state fiscal year 20 8 of other federal grants receipts, and funds, and other nonstate 20 9 funds. 20 10 The section of the bill making an appropriation to the 20 11 economic development authority in an amount anticipated to be 20 12 received from the federal government under Pub.
