Section
1.
Section
73.1,
subsection
1,
Code
2021,
is
amended
1
to
read
as
follows:

1.
Every
commission,
board,
committee,
officer,
or
other
3
governing
body
of
the
state,
or
of
any
county,
township,
school
4
district
or
city,
and
every
person
acting
as
contracting
or
5
purchasing
agent
for
any
such
commission,
board,
committee,
6
officer,
or
other
governing
body
shall
use
only
those
products
7
and
provisions
grown
and
coal
produced
within
the
state
of
8
Iowa,
when
they
are
found
in
marketable
quantities
in
the
9
state
and
are
of
a
quality
reasonably
suited
to
the
purpose
10
intended,
and
can
be
secured
without
additional
cost
over
11
foreign
products
or
products
of
other
states.
This
section
12
shall
apply
to
horticultural
products
grown
in
this
state
even
13
if
the
products
are
not
in
the
stage
of
processing
that
the
14
agency
usually
purchases
the
product.
However,
this
section
15
does
not
apply
to
a
school
district
purchasing
food
while
the
16
school
district
is
participating
in
the
federal
school
lunch
or
17
breakfast
program.

Sec.
2.
Section
73.2,
subsection
1,
paragraph
b,
Code
2021,
19
is
amended
to
read
as
follows:

b.
All
such
requests
and
bids
shall
contain
a
paragraph
in
21
easily
legible
print,
reading
as
follows:

By
virtue
of
statutory
authority,
a
preference
will
be
given
23
to
products
and
provisions
grown
and
coal
produced
within
the
24
state
of
Iowa.

Sec.
3.
REPEAL.
Sections
73.6,
73.9,
and
73.10,
Code
2021,
26
are
repealed.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
29
the
explanation’s
substance
by
the
members
of
the
general
assembly.
30
This
bill
strikes
a
requirement
that
any
commission,
board,
31
county
officer,
or
other
governing
body
of
the
state,
or
of
any
32
county,
township,
school
district,
or
city,
purchase
or
use
33
coal
mined
or
produced
in
Iowa
by
producers
who
comply
with
34
Iowa
workers’
compensation
and
mining
laws.
The
bill
