Senate File 406 - Introduced SENATE FILE BY COMMITTEE ON TRANSPORTATION (SUCCESSOR TO SF 211) A BILL FOR 1 An Act exempting motor vehicles carrying an implement of 2 husbandry from certain permit requirements. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1368SV (2) 87 ns/nh PAG LIN 1 1 Section 1. Section 321.453, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3. A motor vehicle that is operated by a 1 4 farmer and that is carrying an implement of husbandry between 1 5 fields, locations for repair, or locations for storage of the 1 6 implement of husbandry shall be exempt from any requirement to 1 7 obtain a permit under section 321.463, 321.471, or 321.474. 1 8 Nothing in this subsection shall be construed to exempt such 1 9 a vehicle from any requirement or restriction other than a 1 10 requirement to obtain a permit, including but not limited to 1 11 requirements or restrictions relating to size, weight, load, 1 12 lighting, flags, equipment, or manner of operation. For the 1 13 purposes of this subsection, "farmer" means as defined in 1 14 section 142D.2. 1 15 EXPLANATION 1 16 The inclusion of this explanation does not constitute agreement with 1 17 the explanation's substance by the members of the general assembly. 1 18 Code section 321.453 exempts certain motor vehicles and 1 19 equipment from the provisions of Code chapter 321 (motor 1 20 vehicles and law of the road) governing size, weight, and load, 1 21 and the permit requirements of Code chapter 321E (vehicles of 1 22 excessive size and weight). Such motor vehicles and equipment 1 23 include fire apparatus, certain road maintenance equipment, 1 24 implements of husbandry when moved or moving upon a highway 1 25 that is not a portion of the interstate, and certain equipment 1 26 used primarily for construction of permanent conservation 1 27 practices on agricultural land. However, such motor vehicles 1 28 and equipment are not exempt from the provisions of Code 1 29 section 321.463 (maximum gross weight), 321.471 (restrictions 1 30 by local authorities), or 321.474 (restrictions by the 1 31 department of transportation), which include certain permitting 1 32 provisions. 1 33 This bill provides that a motor vehicle that is operated by 1 34 a farmer and that is carrying an implement of husbandry between 1 35 fields, locations for repair, or locations for storage of the 2 1 implement of husbandry shall be exempt from any requirement 2 2 to obtain a permit under Code section 321.463, 321.471, or 2 3 321.474.
