  1  1    Section 1.  Section 282.18, subsection 8, Code 2017, is
  1  2 amended to read as follows:
  1  3    8.  If a request filed under this section is for a child
  1  4 requiring special education under chapter 256B, the request to
  1  5 transfer to the other district shall only be granted if the
  1  6 receiving district maintains a special education instructional
  1  7 program which is appropriate to meet the child's educational
  1  8 needs and the enrollment of the child in the receiving
  1  9 district's program would not cause the size of the class in
  1 10 that special education instructional program in the receiving
  1 11 district to exceed the maximum class size in rules adopted by
  1 12 the state board of education for that program. For children
  1 13 requiring special education, the board of directors of the
  1 14 district of residence shall promptly provide all reasonable
  1 15 assistance in completing forms necessary in order for the
  1 16 receiving district to receive medical assistance reimbursement
  1 17 for services the receiving district provides in accordance
  1 18 with the student's individualized education program, and shall
  1 19  pay to the receiving district the actual costs incurred in
  1 20 providing the appropriate special education.

  1 22 The inclusion of this explanation does not constitute agreement with
  1 23 the explanation's substance by the members of the general assembly.
  1 24    This bill requires the school district of residence to
  1 25 promptly assist the receiving district in completing Medicaid
  1 26 reimbursement forms that the receiving district must submit in
  1 27 order to receive reimbursement for special education services
  1 28 that it provides to a child who requires special education and
  1 29 is participating in open enrollment.
