PARTICIPANTS
IN
AN
ADULT
DAY
SERVICES
PROGRAM.
BE
IT
ENACTED
BY
THE
GENERAL
ASSEMBLY
OF
THE
STATE
OF
IOWA:
Section
1.
NEW
SECTION
.
231D.19
Admission
and
retention
of
participants.
An
adult
day
services
program
shall
not
knowingly
admit
or
retain
a
participant
who
meets
any
of
the
following
criteria:
1.
Is
under
the
age
of
eighteen.
2.
Requires
routine
three-person
assistance
with
standing,
transfer,
or
evacuation.
3.
Poses
a
danger
to
the
participant,
other
participants,
or
the
adult
day
services
program
staff.
“Pose
a
danger”
may
include
but
is
not
limited
to
the
following
situations:
a.
The
participant
chronically
elopes
despite
intervention.
b.
The
participant
is
sexually
or
physically
aggressive
or
abusive.
c.
The
participant’s
verbal
abuse
is
unmanageable
by
staff.
