2024,
is
amended
to
read
as
follows:

A
school
district
with
a
certified
enrollment
plus
the
3
number
of
students
who
open
enroll
into
the
district
of
4
fewer
than
two
hundred
fifty
pupils
in
the
entire
district
5
or
certified
enrollment
plus
the
number
of
students
who
open
6
enroll
into
a
high
school
in
the
district
of
fewer
than
one
7
hundred
pupils
in
high
school
shall
not
expend
the
amount
8
received
for
new
construction
without
prior
application
to
the
9
department
of
education
and
receipt
of
a
certificate
of
need
10
pursuant
to
this
subsection
.
A
certificate
of
need
is
not
11
required
for
repairing
schoolhouses
or
buildings,
equipment,
12
technology,
or
transportation
equipment
for
transporting
13
students
as
provided
in
section
298.3
,
or
for
construction
14
necessary
for
compliance
with
the
federal
Americans
With
15
Disabilities
Act
pursuant
to
42
U.S.C.
§12101
–
12117.
In
16
determining
whether
a
certificate
of
need
shall
be
issued
or
17
denied,
the
department
shall
consider
all
of
the
following:

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
school
district
enrollment
calculations
22
for
the
purposes
of
the
secure
an
advanced
vision
for
education
23
(SAVE)
fund.
24
On
July
1,
2008,
the
state’s
local
sales
and
use
taxes
25
increased
from
5
to
6
percent.
The
increase
is
used
solely
to
26
fund
the
SAVE
fund,
and
the
SAVE
fund
is
used
solely
to
provide
27
revenues
to
local
school
districts
for
school
infrastructure
28
purposes
or
school
district
property
tax
relief.
29
One
requirement
of
the
SAVE
fund
is
that
a
school
with
a
30
certified
enrollment
of
fewer
than
250
pupils
in
the
entire
31
district
or
certified
enrollment
of
fewer
than
100
pupils
32
in
high
school
may
not
expend
amounts
received
for
new
33
construction
without
prior
application
to
the
department
of
34
education
and
receipt
of
a
certificate
of
need.
