S.F. 2096 Section 1. Section 904.513, subsection 2, Code 2011, is 1 amended to read as follows: 2 2. Upon request by the director, a county shall provide 3 temporary confinement for offenders allegedly violating the 4 conditions of assignment to a program under this chapter , 5 if space is available in the county. The department shall 6 negotiate a reimbursement rate with each county. The amount 7 to be reimbursed shall be determined by multiplying the number 8 of days a person is confined by the average daily cost of 9 confining a person in the county facility as negotiated with 10 the department. A county holding offenders in jail due to 11 insufficient space in a community residential facility shall 12 be reimbursed. Payment shall be made upon submission of a 13 voucher executed by the sheriff and approved by the director. 14 A voucher seeking payment shall be submitted within fifteen 15 thirty days of the end of a calendar quarter. If a voucher 16 seeking payment is not made within fifteen thirty days of the 17 end of the calendar quarter, the request may shall be denied 18 by the department. 19 Sec. 2. Section 904.908, subsection 3, Code 2011, is amended 20 to read as follows: 21 3. Any request for reimbursement under subsection 2 shall 22 be made within fifteen thirty days of the end of a calendar 23 quarter. If a request for reimbursement is not made within 24 fifteen thirty days of the end of the calendar quarter, the 25 request may shall be denied by the department. 26 Sec. 3. Section 906.17, subsection 3, Code 2011, is amended 27 to read as follows: 28 3. Any request for reimbursement under subsection 2 shall 29 be made within fifteen thirty days of the end of a calendar 30 quarter. If a request for reimbursement is not made within 31 fifteen thirty days of the end of the calendar quarter, the 32 request may shall be denied by the department of corrections. 33 EXPLANATION 34 This bill relates to reimbursements for state prisoners 35 -1- LSB 5323SV (2) 84 jm/sc 1/ 2
S.F. 2096 confined in a county jail. 1 The bill lengthens the time period a county may request 2 reimbursement from the department of corrections for confining 3 a person sentenced to the custody of the department of 4 corrections who is temporarily confined in a county jail due to 5 alleged violations of an assignment at a treatment facility or 6 violations of work release or parole. The time period a county 7 may request reimbursement from the department of corrections 8 is extended by the bill from within 15 days of the end of the 9 calendar quarter to within 30 days of the end of the calendar 10 quarter.
